RESOLUTION NO. ) ESQ a -g 7 <br /> A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND <br /> APPROVING THE ISSUANCE OF SCRAP METAL/JUNK DEALERS/ <br /> TRANSFER STATION LICENSES FOR THE CALENDAR YEAR 1987 <br /> WHEREAS, the Common Council of the City of South Bend <br /> recognizes the contributions that operations such as junk/scrap and <br /> recycling dealers make to the community; and the Council further <br /> realizes that such operations must be reasonably regulated in order <br /> to minimize any environmental or aesthetic nuisances which may be <br /> created by the operations of scrap/junk/and recycling dealers within <br /> the City; and <br /> WHEREAS , the Common Council of the City of South Bend has <br /> enacted reasonable rules and regulations with regard to the issuance <br /> of licenses and the operations of the scrap/junk/and recycling <br /> dealers ; <br /> WHEREAS , in accordance with these rules and regulations , <br /> inspections of the below listed scrap/junk/and recycling operations <br /> have been completed by the Department of Code Enforcement and the <br /> Fire Department Prevention Bureau, and it has been found that such <br /> premises are fit and proper for the maintenance and operation of <br /> such businesses ; and <br /> WHEREAS , the Board of Public Works , at its meeting held on <br /> April 28 , 1987 , recommended the issuance of licenses for the below <br /> listed applicants in the City of South Bend by appropriate action of <br /> the Common Council. <br /> WHEREAS , the below-listed properties have been licensed by the <br /> City of South Bend as scrap yards for the past several years , both <br /> prior to and since 1980 ; and <br /> WHEREAS , on September 15 , 1980 , the Council passed Resolution <br /> No. 819-80 placing the following conditions upon the use of the <br /> Prairie Street property: <br /> (a) That no shredders shall be allowed to operate at <br /> this location. <br /> (b) That no sheerer in excess of 1 , 100 tons shall be <br /> allowed to operate at this location. <br /> (c) That permanent underground containers of suitable <br /> material be housed on this location for all oils , <br /> solvents , and other fluids drained at this facility. <br /> WHEREAS , a portion of the property located at 1305 Prairie <br /> Avenue is within One Thousand ( 1, 000) feet of certain Zoning Use <br /> Districts and the use of that portion of the property as a scrap <br /> yard is subject to a waiver by the Council pursuant to Section <br /> 4-51(d) (2) of the South Bend Municipal Code; and <br /> WHEREAS, on April 24 , 1984 , at the request of the Licensee of <br /> the Prairie Street property, this Council passed Resolution No. <br /> 1136-84 waiving the One Thousand ( 1 ,000) foot restriction on said <br /> property in order to allow the operation of a scrap yard within One <br /> Thousand ( 1 , 000) feet of, but not closer than Five Hundred (500) <br /> feet of, the Zoning Use Districts listed in Section 4-51(d) (2) of <br /> the South Bend Municipal Code; and <br />
