"At <br /> AN ORDINANCE RELATING TO THE PROTECTION <br /> OF THE-INTERSECTION OF THE RIGHT-OF-WAY <br /> d�7 OF THE GRAND TRUNK WESTERN RAILROAD <br /> COMPANY, WITH 22ND AND 26TH Srkth 15, <br /> PUBLIC: HIGHWAYS, IN TO CITY OF SOUTH <br /> BIND. INDIANA. <br /> T EREAS, the amount of traffic at the intersection of the right-of-way <br /> of the Grand Trunk Western Railroad Company and 22nd. and 26th Streets, public <br /> highways located in the City of South Bend, Indiana, has become so great that <br /> the proper protection of the public travelling on said public highways, across <br /> said intersections, requires the placing of some warning signals at these <br /> intersections; and, <br /> WHEREAS, the said Grand Trunk Western Railroad Company has voluntarily <br /> placed at each of said intersections, automatic track circuit signals which are <br /> commonly known as flashlights; and <br /> WHEREAS, in the opinion of this Common Council the said track circuit <br /> . signals, commonly known as flashlights, as now placed, are clearly as good and <br /> sufficient for the protection of the travelling public as any other safeguard; and, <br /> WHEREAS, it is the desire and intention of this Council to accept and <br /> approve said installation of said automatic track circuit signals: <br /> NOW THEREFORE, BE IT ORDAINED by the Common Council of South Bend, <br /> SECTION I. That the aforesaid installation of said automatic track <br /> circuit signals, at the intersections of its right-of-way with 22nd and 26th <br /> Streets in the City of South Bend, Indiana, by the Grand Trunk Western Railroad <br /> Company, is now and hereby accepted and approved. <br /> SECTION II. That the said Grand Trunk Western Railroad Company be, and <br /> it is hereby required to protect each of the said intersections by the operation <br /> of said automatic track circuit signals, during the full twenty-four hours of <br /> each day, and that all ordinances or parts of ordinances and resolutions in- <br /> consistent herewith are hereby repealed. <br /> SECTION III. That any violation of any of the provisions of this <br /> ordinance shall be punished by a fine of not less than $50.00, and that each <br /> violation shall constitute a separate offense. <br /> SECTION IV.
