�� <br /> ORDINANCE NO. <br /> AN ORDINANCE CONCERNING THE SOUTH BEND ;•:iricIPAI, AIRPORT <br /> MID ESTABLISHING A DEPARTYENT OO <br /> AVIATION. <br /> WHEREAS , the Common Council of the City of South Bend has <br /> been authorized by "AN ACT AUTHORIZING. CITIES OF THE SEC= CUSS TO <br /> ACQUIRE, ESTABLISH, CONSTRUCT, II;I=ROVE, EQUIP, NAINTAIN AND OPERATE <br /> AIRPORTS AND LANDING FIELDS AND ESTABLISH A DEP_'PT3:ENT OF AVIATION <br /> IN CITIES OF THE SECOND CLASS, DEFINING ITS POWERS AND DUTIES ; CON- <br /> FERRING CERTAIN POWERS UPON THE COMMON COUNCIL JTT) MAYOR OF SUCH <br /> CITIES MID DECLARING AN EMERGENCY-;°-passed by the General Assembly <br /> of the State of Indiana at its seventy-sixth regular session and <br /> approved March 16, 1929, being Chapter 57 of the Acts of the State <br /> of Indiana; as published for the year 1929, to adopt an ordinance <br /> in favor of the acquisition, improvement, operation and/or maintenance <br /> of an airport under the provisions of said Act ; and <br /> :7T REAS, under previous grant of authority, the City of <br /> South Bend has acquired and does operate a municipal airport ; and <br /> ';fn REAS , there is a necessity for the continuance of said <br /> airport and for its operation under the provisions of the above said <br /> Act, :and this Council is in favor thereof; <br /> NOW, THEREFORE, BE IT ORDAINED by the Common Council of the <br /> City of South Bend, Indiana: <br /> SECTION 1 . That the acquisition, improvement , operation <br /> and/or maintenance of a municipal airport of the City of South Bend <br /> and any airport or airports, landing field or landing fields, be- <br /> longing to, operated and/or maintained by said City and all other <br /> matters pertaining thereto be done (subject .to the authority and under <br /> the provisions of the above said Act, and that there be established <br /> as one of the executive departments of said City, a department of <br /> aviation, which shall be under the control of a board of four (4) <br /> members, to be known as the Board of Aviation Commissioners and to be <br /> i <br />
