ORDINANCE NO. 9 70 <br /> AN ORDINANCE AMENDING ORDINANCE NUMBER 1758 ADOPTED FEBRUARY <br /> • <br /> 22, 1915 AND REPEALING:: SECTION 6 OF ORDINANCE NUMBER <br /> 1784, ADOPTED MAY 10th. 1915. <br /> BE IT ORDAINED by the Common Council of the City of South <br /> Bend, Indiana. <br /> SECTION 1 . <br /> That Section One of Ordinance Number 1758, being Ordinance ' <br /> . Number 458 of a compilation of ordinances in book form known as Ordin- <br /> ance Number 1827 and adopted February 14, 1916, be and the same is <br /> hereby amended to read as follows, to-wit: <br /> "Every person who shall sell, barter, or • <br /> exchange, or offer for sale, barter, or exchange at re- <br /> tail any goods, wares or merchandise (which terms shal_ - <br /> also include all fruits, vegetables, refreshments, con- <br /> fectionery and country produces) by traveling from place <br /> to place in said city and selling or offering to sell such • <br /> things from a pack carried on the person or from a wagon, <br /> push-cart, • or other vehicle or mode or method of transporta- <br /> tion shall be deemed a peddler and shall, before engaging in <br /> • such business, obtain a peddler' s license as elsewhere in ' <br /> said Ordinance Number 17.56 provided. Such peddler, while on <br /> the streets and public places of said city, shall keep moving <br /> . from place to place save and except while in the act of ne- <br /> gotiating a sale or sales . " • <br /> SECTION 2. <br /> •j That Section Four of said Ordinance Number 1758, being • <br /> Section 461 of said Ordinance Number 1784, be and the same is hereby <br /> amended to read as follows, to-wit: <br /> • <br /> "The fees for licenses for such peddling for a <br /> period of one quarter shall be as follows: <br /> • Pack Peddler' v 8.00 per period <br /> - Push-Cart, Wagon or Vehicle Peddler w 50.00 per period. " ' <br /> SECTION 3. <br /> • <br /> That Section Nine of said Ordinance Number 1758, being <br /> Section 466 of said Ordinance Number 1784, .be and the same is hereby <br /> amended to read as follows, to-wit: <br /> "That the provisions of .this Ordinance shall <br /> not apply to the sale of newspapers nor to the sale of <br /> produce, vegetables, or fruits when such produce, vege- <br /> tables, or fruits when such produce, vegetables or fruit <br /> is raised, grown and produced by the person so selling the • <br /> • same, nor shall the provision of this Ordinance apply to <br /> wholesale travelling merchants who sell. on'y to resident <br /> retail dealers in wholesale quantities, provided, however, <br /> ' that all persons who desire to sell produce, vegetables, <br /> or fruit of their own raising shall, before peddling the <br /> same apply to the City Controller and make affidavit to <br /> the effect that the produce, vegetables or fruit which he <br /> desires to sell is of his own raising and if such person <br /> fails or refuses to make such affidavit, then if he peddle <br /> he shall be liable to the penalties of said Ordinance. " <br /> SECTION 4. <br /> That a new section to be known as Section 10-a of said <br />
