ORDINANCE NO. 2806 AN ORDINANCE AMENDING ORDINANCE NUMBER 2752 KNOWN AS AN ORDINANCE TO LICENSE AND REGULATE TAXICAB OWNERS, AND TAXICAB DRIVERS,ETC. , BY CREATING AND ADDING THERETO THREE NEW SECTIONS TO BE NUMBERED 31-a, 31-b , and 31-c. BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: That Ordinance Numbered 2752 being an Ordinance to license and regulate taxicab owners, taxicab drivers, etc. , be and the same is hereby amended by creating and adding thereto three sections known as Sedtions 31-a, 31-b and 31-c and which sections are as follows, to wit: SECTION 31-a ! Every taxicab licensed under the provisions of said ordinance shall have the name of its owner plainly painted in letters at least two inches in height in the center of the main panel of either door on each side of said vehicle and no other lettering shall appear upon such doors. Said lettering shall be removed in the event of change of ownership and if again used as a taxicab the proper lettering shall be placed thereon before the same shall be used again. li SECTION 31-b Every taxicab licensed under the provisions of said ordinance shall have firmly attached to it and in good working order a mechanical device known as a "governor" , which device controls the speed of such taxicab. Said governor shall be set so as to prevent said taxicab from being driven faster than thirty (30) miles per hour and it is hereby made the duty of both the owner and the driver of such taxicab to see that said governor shall be set so as to prevent said taxicab from being driven faster than thirty (30) miles per hour and it is hereby made the duty of both the owner and the driver of such taxicab to see that said governor shall be in good working order at all times said car is used for taxicab purposes, The tampering with said governor so as to render it ineffective in its control of the speed of said taxicab and the preventing of the same from being run at more than said thirty (30) miles per hour shall be a violation of said ordinance and such driver or operator shall be subject to a fine of not less than Ten Dollars ( $10.00)' and not more than the penalty provided in said ordinance. ( SECTION 31-c Whenever any owner and/or operator and/or licensee who has heretofore qualified under said Ordinance Number 2752, an ordinance licensing and regulating taxicabs, etc. , to operate and/or drive taxicabs, shall file with the Board of Public Safety of said City on blanks by it provided, an application for a permit to license to occupy a certain designated place upon a public street or place of said City as a stand for a taxicab or taxicabs and shall show on such application the number of taxicabs he wishes to maintain at the particular stand, and represents that he will maintain on such stand or in the building next adjacent thereto , for at least eight hours bf each day, a designated person or persons to represent said taxicab owner, operator or licensee which person is authorized to take charge of and control such stand and receive calls for cabs, then the said Board is hereby authorized and empowered to grant a license or permit to such owner and/or operator and/or lessee to
