RESOLUTION NO. 1� $y- <br />RESOLUTION RATIFYING EXECUTIVE ORDER <br />INDICATING WILLINGNESS TO ACCEPT <br />MANAGEMENT RESPONSIBILITIES IN ACCORDANCE WITH <br />THE 208 WATER QUALITY MANAGEMENT PLANNING REQURIEMENTS <br />WHEREAS, the Federal Water Pollution Control Act (P.L. 92 -500) as <br />amended by the Clean Water Act of 1977 (P.L. 95 -217) requires the <br />development and implementation of water quality management plans for <br />the purpose of preventing further degradation of our streams; and <br />WHEREAS, pursuant to Section 208 and 303(e) of the Act, the <br />Governor of the State of Indiana has designated the Stream Pollution <br />Control Board as the state agency responsible for water quality <br />management; and <br />WHEREAS, pursuant to Section 208, the Stream Pollution Control <br />Board designates specific local units of government and management <br />agencies for the purpose of implementing various pollution control <br />measures and practices recommended in the State's Water Quality <br />Management Plan; and <br />WHEREAS, a process exists by which all municipal units of <br />government and special districts who intend to abate pollution may <br />enter into the Construction Grants process for the purpose of <br />constructing wastewater treatment facilities; and <br />WHEREAS, the municipality of South Bend, Indiana, desires to <br />abate water pollution within its area of legal jurisdiction; and <br />WHEREAS, the municipality of South Bend, Indiana, further desires <br />to be in compliance with the requirements for obtaining Federal <br />funding for the purpose of this control; and <br />WHEREAS, the Environmental <br />directed that only a certified <br />agency can be the recipient of <br />construction grant award. <br />Protection Agency, Region V, has <br />and approved designated management <br />a 201 municipal facilities <br />WHEREAS, it was necessary for then Mayor Roger O. Parent on <br />December 31, 1987, to sign an Executive Order designating the South <br />Bend Wastewater Board of Commissioners to be the certified and <br />approved designated management agency for the control of water <br />pollution sources within its area of legal jurisdiction. <br />THEREFORE, by this Resolution, the Common Council of the City of <br />South Bend, Indiana, ratifies the actions of then Mayor Roger O. <br />Parent on December 31, 1987, in his Executive Order and states its <br />desire that the South Bend Wastewater Board of Commissioners be the <br />certified and approved designated management agency for the control <br />of water pollution sources within its area of legal jurisdiction. <br />This resolution shall be in full force and effect upon its <br />passage and its approval by the Mayor. <br />By Resolution passed by the South Bend Common Council at its <br />meeting this �Cf� day of January, 1988. <br />PRESENTED ( - V -" <br />NOT APPROVED <br />ADOPTED ( - - g g Ca N.
