PUBLIC WORKS AND PROPERTY VACATION DECEMBER 8, 2008 <br />The December 8, 2008 meeting of the Public Works and Property Vacation Committee of the <br />South Bend Common Council was called to order by its Chairperson, David Varner at 3:30 p.m. in <br />the Council's Informal Meeting Room. <br />Committee Members Present: David Varner, Chairperson, Tom LaFountain <br />Other Council Members Present: Oliver J. Davis, Ann Puzzello, Timothy Rouse <br />Others Present: Don Inks, Jamie Loo, Gary Gilot, Derek Spier, Kathleen Cekanski-Farrand, Rita <br />Kopala, Frank Agostino, Carl Littrell, John Voorde <br />A enda: <br />Bill No. 73-08 -Vacate ROW Callender Street <br />Councilmember Varner chairing the hearing called upon Derek Spier representing the petitioner <br />to make a presentation. Mr. Spier explained that due to a survey error the Callendar St. ROW <br />had to be re-platted. He said the Board of Works submitted a favorable recommendation subject <br />to re-platting lots so none are landlocked and due to previous non-access easement, access to <br />U.S. 31 would continue to be restricted. <br />Frank Agostino attorney for the petitioner said the "subject to" criteria were acceptable to the <br />petitioner. <br />Tim Rouse asked if the agreement needed to be in writing. It need not be. <br />Lacking a quorum no committee recommendation was given. <br />Bill No. 74-08 -Vacate ROW Crescent Oaks Section I <br />This bill also asks approval of a replat in Section I of the Crescent Oaks subdivision due to a <br />survey error.
