Amend Ordinance No. 2876 Protect Intersection of Grand Trunk Railroad with 35th & Logan Streets

ORDINANCE NO. �,' 1D /f i'MREkS, heretofore,to -wit: On the �� day of August, 1930, there was adopted by this Council an ordinance, being Ordinance No. '-F7 4, requir- ing said Grand Trunk Western Railroad Company to protect 35th Street and also Logan Street, in the City of South Bend, Indiana, with automatic track circuit signals at the intersection of its railroad with said streets, which protec- tion shall continue during the full twenty -four hours of each day; and, Vk1ERELS, Section 4 of said Ordinance provided as follows: "This ordinance shall be in full force and effect from and after December 1, 193D, after its passage and legal publication "; and, PIHEREA.S, said Grand Trunk Western Railroad Company is now proceeding with the installation and erection of said track circuit signals, at the inter- section of its right -of -way with said 35th Street and also Logan Street,in the City of South Bend , Indiana ; and, ^,JHFME S, from causes beyong its.control it is now evident that said Grand Trunk Western Railroad Company will be unable to complete said installation and erection by December 1, 1930; and, WF..EREAS, this Council is now of the opinion that said Grand Trunk Western Railroad Company should be granted ten (10) days additional time for the installation of said automatic track circuit signals: NOW THEREFORE, BE IT ORDAINED BY THE ColmoN COUNCIL of the City of South Bend: Section 1. That Section 4 of Ordinance No. )k7 G heretofore adopted by this Council, on the !I day of August, 1930, be and the same is hereby amended to read as follows: "SECTION 4. This ordinance shall be in full force and effect from and after December 10, 1930, after its passage and legal publication ". Section 2. Whereas an emergency exists for the immediate adoption of this ordinance the same shall be in full force and effect from and after - 1 -
