n <br />ORDINANCE NO.��� <br />An Ordinance declaring the non - existence of a City Purchasing <br />Agent or City Purchasing Clerk and prohibiting the appointment of <br />any person to such non:- existent office or position. <br />',- Y=RFAS, no safeguards or precautions whatsoever to protect <br />the interests of the public are thrown about the operations and <br />powers of so important a position as that of City Purchasing <br />Agent or Purchasing Clerk due to the absence of any state law <br />creating such an office or position in-Second Class cities; <br />therefore <br />Be it Ordained by the Common Council of the City of South Bend, <br />Indiana: <br />Section 1. That the office of a so- called. City Purchasing <br />Agent or Purchasing Clerk for the City of South Bend, Indiana, be, <br />and the same is hereby declared <br />connection with any department, <br />South Bend, Indiana. <br />to be non - existent under or in <br />bureau or office of the City of <br />Section 2. That the appointment by an executive officer or <br />official, or by any department board of the City of any person to <br />serve as a City Purchasing Agent or Purchasing Clerk, or to serve <br />in any like capacity, shall be inoperative and of no effect, and <br />any officer or official making any such appointment or authorizing <br />or making payment of any city funds to any person:fo act in any <br />such capacity, shall be liable on their official bonds for any <br />and all moneys paid out by the city on account of such unlawful <br />appointment. <br />Section 3.
