Marion <br />Maradik /Relos <br />'Mr. Pawlowski noted the Police Department and Community Investment recommended a <br />different location due to Orange St. being a major artery and direct route for public safety <br />response. He asked Mr. Murray Miller, Petitioner, if a different location could be utilized, such <br />as one of the less -traveled side streets. Mr. Miller questioned why the Board would have an issue <br />with this location when there are events approved in the center of downtown and Eddy St. is <br />closed all the time. Mr. Pawlowski noted the issue with this one is the location of a Fire Station <br />on the corner, and this route a main arterial for them, as well as Police. He stated he was hoping <br />to minimize disruption of this route. Mr. Miller informed the Board that they use the Martin <br />Luther King Center on one side of the street, and the church on the other side for this event. He <br />explained that children will be crossing back and forth on the street. Mr. Pawlowski asked why <br />they couldn't cross at the crosswalk with assistance from Public Safety personnel and asked Mr. <br />Miller if he could work on moving to a side street next year, and cross at the crosswalks. Mr. <br />Miller stated he would let the committee know, adding he was only one person on the committee. <br />Mr. Gilot stated he has asked all of these questions before when this request was originally <br />brought to the Board. He stated there is a need for a classification of what is a "major arterial", <br />noting that he didn't feel this section of Orange St. is one. Mr. Eric Horvath, Public Works, <br />stated he could provide that list, but Public Safety would need to send their own list of main <br />arterial routes. <br />TABLE PETITION TO VACATE THE SECOND EAST/WEST ALLEY NORTH OF <br />NORTHSIDE BLVD. FROM PARRY ST. TO FIRST NORTH/SOUTH ALLEY <br />Mr. Gilot indicated that Denise and Bobby Clark, 521 Parry St, South Bend, IN 46617, have <br />submitted a request to vacate the above referenced alley. Mr. Gilot advised the Board is in <br />receipt of favorable recommendations concerning this Vacation Petition from the Area Plan <br />Commission, Police Department, Fire Department, and Community Investment. Area Plan <br />stated the vacation would not hinder the growth or orderly development of the unit or <br />neighborhood in which it is located or to which it is contiguous. The vacation would not make <br />access to the lands of the aggrieved person by means of public way difficult or inconvenient. <br />The vacation would not hinder the public's access to a church, school or other public building or <br />place. The vacation would not hinder the use of a public right-of-way by the neighborhood in <br />which it is located or to which it is contiguous. Mr. Gilot advised the Board is in receipt of <br />unfavorable recommendations concerning this Vacation Petition from the Engineering <br />Department. Per the City Engineer, the City is planning on running a sewer through that alley, <br />therefore, would object to a vacation without proper easements. Attorney Michael Schmidt stated <br />after review, the Ordinance does not provide for future utility easements, only existing ones, so <br />an easement will need to be drawn -up prior to this vacation. Therefore, Mr. Relos made a motion <br />to table this item until the easement is completed. Ms. Maradik seconded the motion which <br />carried. Mr. Relos also requested the description of the location be reviewed on this petition, <br />noting there is uncertainty whether this is actually a street or an alley. <br />
