REGULAR MEETING JULY 28, 2015 252 Expo * p.m. Barbara Procession August 8, On Route as Pawlowski/Relos Hawkins- 2015; 8:00 Submitted Subject to Cleveland a.m. to 12:00 Participants staying p.m. on Sidewalks Riley High Procession September 11, On Route as Tabled School 2015; 4:00 Submitted; Pawlowski/Maradik p.m. to 6:30 Mr. Pawlowski p.m. stated there is an issue with the route being on Ireland Rd., a main arterial, and a gap in the route that needs to be resolved Center for Procession September 13, On Route as Relos/Maradik Hospice Care 2015; 7:00 Submitted a.m. to 6:00 p.m. Frank's Place Sidewalk Cafe 327 W. Marion Maradik /Relos 'Mr. Pawlowski noted the Police Department and Community Investment recommended a different location due to Orange St. being a major artery and direct route for public safety response. He asked Mr. Murray Miller, Petitioner, if a different location could be utilized, such as one of the less -traveled side streets. Mr. Miller questioned why the Board would have an issue with this location when there are events approved in the center of downtown and Eddy St. is closed all the time. Mr. Pawlowski noted the issue with this one is the location of a Fire Station on the corner, and this route a main arterial for them, as well as Police. He stated he was hoping to minimize disruption of this route. Mr. Miller informed the Board that they use the Martin Luther King Center on one side of the street, and the church on the other side for this event. He explained that children will be crossing back and forth on the street. Mr. Pawlowski asked why they couldn't cross at the crosswalk with assistance from Public Safety personnel and asked Mr. Miller if he could work on moving to a side street next year, and cross at the crosswalks. Mr. Miller stated he would let the committee know, adding he was only one person on the committee. Mr. Gilot stated he has asked all of these questions before when this request was originally brought to the Board. He stated there is a need for a classification of what is a "major arterial", noting that he didn't feel this section of Orange St. is one. Mr. Eric Horvath, Public Works, stated he could provide that list, but Public Safety would need to send their own list of main arterial routes. TABLE PETITION TO VACATE THE SECOND EAST/WEST ALLEY NORTH OF NORTHSIDE BLVD. FROM PARRY ST. TO FIRST NORTH/SOUTH ALLEY Mr. Gilot indicated that Denise and Bobby Clark, 521 Parry St, South Bend, IN 46617, have submitted a request to vacate the above referenced alley. Mr. Gilot advised the Board is in receipt of favorable recommendations concerning this Vacation Petition from the Area Plan Commission, Police Department, Fire Department, and Community Investment. Area Plan stated the vacation would not hinder the growth or orderly development of the unit or neighborhood in which it is located or to which it is contiguous. The vacation would not make access to the lands of the aggrieved person by means of public way difficult or inconvenient. The vacation would not hinder the public's access to a church, school or other public building or place. The vacation would not hinder the use of a public right-of-way by the neighborhood in which it is located or to which it is contiguous. Mr. Gilot advised the Board is in receipt of unfavorable recommendations concerning this Vacation Petition from the Engineering Department. Per the City Engineer, the City is planning on running a sewer through that alley, therefore, would object to a vacation without proper easements. Attorney Michael Schmidt stated after review, the Ordinance does not provide for future utility easements, only existing ones, so an easement will need to be drawn -up prior to this vacation. Therefore, Mr. Relos made a motion to table this item until the easement is completed. Ms. Maradik seconded the motion which carried. Mr. Relos also requested the description of the location be reviewed on this petition, noting there is uncertainty whether this is actually a street or an alley.
