The petitioner is here to answer any questions that you <br />may have. <br />Petitioner: Jeffrey Spoonhower, 1106 Stanfield Street, South Bend — Thank you for allowing me <br />to speak. <br />This being the time heretofore set for the Public Hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. <br />There being no one present wishing to speak to the Council either in favor of or in opposition to <br />this bill, Councilmember Derek Dieter made a motion to adopt resolution 15 -57. Councilmember <br />Oliver Davis seconded the motion which carried and the Resolution was adopted by a roll call vote <br />of nine (9) ayes. <br />15 -58 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF <br />SOUTH BEND DESIGNATING CERTAIN AREAS WITHIN THE CITY <br />OF SOUTH BEND, INDIANA COMMONLY KNOWN AS THE SOUTHEAST <br />CORNER OF ADAMS RD AND DYLAN DR. SOUTH BEND, IN 46628 <br />AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF AN (8) <br />EIGHT YEAR REAL PROPERTY TAX ABATEMENT FOR GLC PORTAGE <br />PRAIRIE LLC <br />WHEREAS, a petition for real property tax abatement consideration has been filed with <br />the City Clerk for consideration by the Common Council of the City of South Bend, Indiana, <br />requesting that the area commonly known as southeast comer of Adams Rd and Dylan Dr, South <br />Bend, IN 46628 and which is more particularly described as: <br />Nw 1/4 Sec 17 -38 -2E Ex Irr Tract Nw Cor & Ex 1.717 Ac to State & Ex 7 Ac +- for N/S Rd <br />& Ex 10.5 Ac +- Parcel 800' N of S Line & E of N/S Rd 06/07 Split to 014601 & 014602 <br />16442CWD 1 -19 -06 Annxd 06 -07 per Ord #9587 -05 Split off 10.073 ac 07 -08 for Ptg <br />Prairie Minor pt of Lot 1& 09/10 7.413ac to Ptg Prairie Minor #2 & 10/11 8.15 ac to Ptg <br />Prairie Minor #3 <br />and which has Key Number 025- 1009 -0146 be designated as an Economic Revitalization Area <br />under the provisions of Indiana Code 6 -1.1 -12.1 et seq., and South Bend Municipal Code Sections <br />2 -76 et seq., and; <br />WHEREAS, petitioner has agreed to and has accepted responsibility to report any changes <br />in the final legal description and to report the final, appropriate Key Number to the Department of <br />Community Investment and to the Office of the City Clerk; and <br />WHEREAS, the Department of Community Investment has concluded an investigation and <br />prepared a report with information sufficient for the Common Council to determine that the area <br />qualifies as an Economic Revitalization Area under Indiana Code 6 -1.1 -12.1, et seq., and South <br />Bend Municipal Code Sections 2 -76, et seg., and has further prepared maps and plats showing the <br />boundaries and such other information regarding the area in question as required by law; and <br />WHEREAS, the Community Investment Committee of the Common Council has reviewed <br />said report and recommended to the Common Council that the area qualifies as an Economic <br />Revitalization Area. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South <br />Bend, Indiana, as follows: <br />16 <br />
