RESOLUTION NO. A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA APPROVING AN INTER -LOCAL GOVERNMENTAL AGREEMENT BETWEEN THE CITY OF SOUTH BEND, INDIANA AND THE COUNTY OF ST. JOSEPH, INDIANA, CONCERNING AMERICAN MOULDING, INC. WHEREAS, the City of South Bend, Indiana (City) is the recipient of an Industrial Development Grant to be used for the purposes set forth in Indiana Code 4- 4 -12 -1 in conjunction with the American Moulding, Inc. project (Project); and WHEREAS, the Project is located outside the corporate limits of the City of South Bend, Indiana but within St. Joseph County, Indiana (County); and WHEREAS, the Project is in the best interest of the citizens of the City and the County and will advance the health, safety, welfare and economic vitality of the City and the County; and WHEREAS, the County and the City desire to enter into an agreement whereby the City's Department of Public Works will bid out and supervise the infrastructure work to be done in the County pursuant to the Grant Agreement and the City's Economic Development Department will administer the Grant funds for the Project; and WHEREAS, the County will assume maintenance responsibility for the public access road after construction is completed; and WHEREAS, the City and the County have informally agreed to construct the infrastructure comprising the Project and desire to formalize said agreement by executing an Inter -Local Government Agreement between the City of South Bend, Indiana and the County of St. Joseph, Indiana concerning American Moulding, Inc., which Agreement is attached hereto and incorporated herein; and WHEREAS, it is the intention of the parties to begin construction on or about April 15, 1989 and to complete same on or about September 15, 1989; and WHEREAS, the receipt and use of these funds were inducements for American Moulding, Inc. to locate its new manufacturing facility in that portion of the Toll Road Industrial Park which is located in the County. NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of South Bend, Indiana as follows: SECTION I. The Inter -Local Governmental Agreement between the City of South Bend, Indiana and the County of St. Joseph, Indiana concerning American Moulding, Inc. is hereby approved. SECTION II.
