Mayor RESOLUTION NO. / -7 7 1 -2D A RESOLUTION OF THE COMMON COUNCIL OF SOUTH BEND, INDIANA APPROVING THE TRANSFER OF CERTAIN REAL ESTATE BY THE SOUTH BEND BOARD OF PUBLIC WORKS TO THE SOUTH BEND REDEVELOPMENT AUTHORITY WHEREAS, on February 26, 1990, the South Bend Board of Public Works, after a public hearing pursuant to I.C. 36- 1 -11 -3, adopted Resolution No. 4 -1990 indicating its intention to transfer certain public right -of -way and public property located within the South Bend Redevelopment Commission's South Bend Central Development Area, and more completely described in said Resolution, which is attached hereto and made a part hereof, to the South Bend Redevelopment Authority for public improvement; and, WHEREAS, all public right -of -way and public property addressed in the Board of Public Works Resolution are in need of public improvement; and, WHEREAS, pursuant to South Bend Redevelopment agreement with the South financing and constructs, Bend Central Development in said Resolution; and, I.C. 36 -7 -14 -25.2 and I.C. 36 -7- 14.5 -14, the Commission has entered into a lease Bend Redevelopment Authority for the 3n of public improvements within the South Area, including those properties described WHEREAS, the South Bend Redevelopment Authority is authorized by I.C. 36 -7- 14.5 -19 to issue bonds in order to finance public improvements in the South Bend Central Development Area as set forth in I.C. 36 -7- 14.5 -11, and the Authority intends to issue such bonds for public improvement in that area; and, WHEREAS, I.C. 36 -7- 14.5 -11 requires that the South Bend Redevelopment Authority hold title to the real estate and public improvements to be made thereon with bond proceeds; and, WHEREAS, pursuant to I.C. 36- 1 -11 -3, the transfer of said property by the Board of Public Works is subject to the approval of the Mayor and the Common Council; and, WHEREAS, on February 27, 1990, the Mayor approved the Board of Public Works Resolution indicating its intention to transfer said property. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City South Bend, Indiana, as follows: SECTION I. The transfer of portions of public right -of -way and public property located in the South Bend Central Development Area and described in South Bend Board of Public Works Resolution No. 4 -1990, which is attached hereto and made a part hereof, to the South Bend Redevelopment Authority pursuant to I.C. 36- 1 -11 -3 and I.C. 36- 1 -11 -8 for public improvement consistent with the purposes set forth in I.C. 36 -7 -14.5 is hereby approved. SECTION II. This Resolution shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor. RESOLUTION NO. 4 -1990 A RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC WORKS INDICATING ITS INTENTION TO TRANSFER CERTAIN REAL ESTATE TO THE SOUTH BEND REDEVELOPMENT AUTHORITY WHEREAS, pursuant to I.C. 36 -9 -6 -3 the South Bend Board of Public Works has custody of all real and personal property of the City; and, WHEREAS, pursuant to I.C. 36 -9 -6 -6 the Board of Public Works is authorized to repair public ways, sidewalks or public places within the City; and, WHEREAS, those portions of public right of way and public property described in Exhibits A through D attached, hereto and made a part hereof, all of which are located within the South Bend Redevelopment Commission's South Bend Central Redevelopment Area, are in need of public improvements; and, WHEREAS, pursuant to South Bend Redevelopment agreement with the South financing and constructi, Bend Central Development in Exhibits A through D; I.C. 36 -7 -14 -25.2 and I.C. 36 -7- 14.5 -14 the Commission has entered into a lease Bend Redevelopment Authority for the Dn of public improvements within the South Area, including those properties described and, WHEREAS, pursuant to I.C. 36 -7- 14.5 -19 the South Bend Redevelopment Authority is authorized to issue bonds in order to finance public improvements as set forth in I.C. 36- 7- 14.5 -11, and the Authority intends to issue such bonds for public improvements in the South Bend Central Redevelopment Area; and, WHEREAS, I.C. 36 -7- 14.5 -11 requires that the South Bend Redevelopment Authority hold title to the real estate and public improvements to be made thereon by the Authority pursuant to I.C. 36 -7 -14.5; and, WHEREAS, parcels of land hereunder transferred by the Board of Public Works to the South Bend Redevelopment Authority for public improvement will continue to be used for public purposes and it is not necessary for the Board of Public Works to hold title to said real estate in order to continue such use; and, WHEREAS, pursuant to I.C. 36- 1 -11 -8 the Board of Public Works may transfer property to another governmental entity by adopting a resolution indicating its intent to do so; and, WHEREAS, the Board of Public Works desires to transfer its interest in the parcels of land described'in Exhibits A through D to the South Bend Redevelopment Authority for repair and public improvements pursuant to I.C. 36- 7- 14.5 -11; and, WHEREAS, pursuant to I.C. 36- 1 -11 -3 the Board of Public Works has been designated by the Mayor as the entity to hold a public hearing on the transfer of said public property and the Board of Public Works has published notice pursuant to I.C. 5 -3 -1 of the public hearing held this date; and, WHEREAS, pursuant to I.C. 36- 1 -11 -3 the transfer of said property is subject to the approval of the Mayor and the Common Council. NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND BOARD OF PUBLIC WORKS AS FOLLOWS: The portions of public right -of -way and public property described in Exhibits A through D attached hereto and made a part hereof, shall be transferred to the South Bend Redevelopment Authority pursuant to I.C. 36- 1 -11 -3 and I.C. 36- 1 -11 -8 for public improvement consistent with the purposes set forth in I.C. 36 -7 -14.5, subject to the approval of the Mayor and the South Bend Common Council. Kernan, Mayor PKIRN:R- PARKCOMMISSIONERS:2 -2- EXHIBIT A Niles Avenue Improvements Project The 100 and 200 blocks of Niles Avenue, more particularly described as: Starting at a point on the west right -of -way line of Niles Avenue, one hundred thirty -two (132) feet south of the south right -of -way line extended of Washington Street continuing north along said west right -of -way line to a point one hundred sixty -five (165) feet north of the north right -of -way line of LaSalle Avenue, thence east a distance of sixty -six (66) feet to a point along the east right -of -way line of Niles Avenue one hundred sixty -five (165) feet north of the north right -of -way line of LaSalle Avenue, thence south along the east right -of -way line to a point one hundred thirty -two (132) feet south of the south right -of -way line of Washington street, thence west a distance of sixty -six (66) feet back to the starting point.
