RESOLUTION NO. iaer• • •• 1•i 11 ' I • •• • • • 1 M • •:.• • • run 1 «�•a1 u I i• I • •• • 1 • • • • •. e•. • I -:1 •••:IL a 101 •- 11. 1 1 1 WHEREAS, the Common Council of the City of South Bend, Indiana has adopted a Declaratory Resolution designating certain areas within the city as Economic Revitalization Areas for the purpose of tax abatement consideration; and WHEREAS, a Declaratory Resolution designated the area commonly ]mown as 117 East Wayne and which is more particularly described as follows: A part of the Northwest Quarter of Section 12, Township 37 North, Range 2 East of the Second Principal Meridian, Portage Township, City of South Bend, Indiana being a part of Lots 50, 51, and 52 of original plat of South Bend, Indiana, more particularly described as follaws: Beginning at the Intersection of the Westerly right -of -way line of St. Joseph Street (85' right-of-way) with the North right-of-way line of Wayne Street (82.5' right -of -way); thence South 89 Degrees 38 Minutes 12 Seconds West (bearing assumed) along the North right-of-way line of Wayne Street 148.84 feet; thence North 00 Degrees 27 Minutes 00 Seconds West, 186.00 feet; thence North 89 Degrees 39 Minutes 34 Seconds East, 165.61 feet; thence Southwesterly 186.99 feet along a segment of a curve to the right having a radius of 912.43 feet, subtended by a chord having a bearing of South 04 Degrees 42 Minutes 19 Seconds West and a length of 186.66 feet to the Point of Beginning and containing 29,835.05 square feet (0.6849 acre) more or less and is subject to easements, restrictions, limitations, and/or covenants of record; a part of said space which is commonly ]mown as Retail Space No. 1 as depicted on the attached architectural drawing which is attached hereto and labeled "Exhibit All and as depicted on "Exhibit All on the Declaratory Resolution No. 1802 -90 as an Economic Revitalization Area; and WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing before the Council has been published pursuant to Indiana Code 6 -1.1- 12.1 -2.5; and WHEREAS, the Council held a public hearing for the purposes of hearing all remonstrances and objections from interested persons; and WHEREAS, the Council has determined that the qualifications for an economic revitalization area have been met. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. The Common Council hereby confirms its Declaratory Resolution designating the area described herein as an Economic Revitalization Area for the purposes of tax abatement. Such designation is for real property tax abatement only and is limited to two (2) calendar years from the date of adoption of the Declaratory Resolution by the Common Council. SECTION II. The Common Council hereby determines that the property owner is qualified for and is granted real property tax deduction for a period of three (3) years. SECTION III. This Resolution shall be in full font and effect from and after its adoption by the Common Council /n proval by the Mayor.
