RESOLUTION NO. <br />iaer• • •• 1•i 11 ' I • •• • • • 1 M • <br />•:.• • • run 1 «�•a1 u I <br />i• I • •• • 1 • • • • •. e•. <br />• I -:1 •••:IL a 101 •- <br />11. 1 1 1 <br />WHEREAS, the Common Council of the City of South Bend, Indiana has adopted <br />a Declaratory Resolution designating certain areas within the city as Economic <br />Revitalization Areas for the purpose of tax abatement consideration; and <br />WHEREAS, a Declaratory Resolution designated the area commonly ]mown as 117 <br />East Wayne and which is more particularly described as follows: <br />A part of the Northwest Quarter of Section 12, Township 37 North, Range <br />2 East of the Second Principal Meridian, Portage Township, City of <br />South Bend, Indiana being a part of Lots 50, 51, and 52 of original <br />plat of South Bend, Indiana, more particularly described as follaws: <br />Beginning at the Intersection of the Westerly right -of -way line of St. <br />Joseph Street (85' right-of-way) with the North right-of-way line of <br />Wayne Street (82.5' right -of -way); thence South 89 Degrees 38 Minutes <br />12 Seconds West (bearing assumed) along the North right-of-way line of <br />Wayne Street 148.84 feet; thence North 00 Degrees 27 Minutes 00 Seconds <br />West, 186.00 feet; thence North 89 Degrees 39 Minutes 34 Seconds East, <br />165.61 feet; thence Southwesterly 186.99 feet along a segment of a <br />curve to the right having a radius of 912.43 feet, subtended by a chord <br />having a bearing of South 04 Degrees 42 Minutes 19 Seconds West and a <br />length of 186.66 feet to the Point of Beginning and containing <br />29,835.05 square feet (0.6849 acre) more or less and is subject to <br />easements, restrictions, limitations, and/or covenants of record; a <br />part of said space which is commonly ]mown as Retail Space No. 1 as <br />depicted on the attached architectural drawing which is attached hereto <br />and labeled "Exhibit All and as depicted on "Exhibit All on the <br />Declaratory Resolution No. 1802 -90 <br />as an Economic Revitalization Area; and <br />WHEREAS, notice of the adoption of a Declaratory Resolution and the public <br />hearing before the Council has been published pursuant to Indiana Code <br />6 -1.1- 12.1 -2.5; and <br />WHEREAS, the Council held a public hearing for the purposes of hearing all <br />remonstrances and objections from interested persons; and <br />WHEREAS, the Council has determined that the qualifications for an economic <br />revitalization area have been met. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South <br />Bend, Indiana, as follows: <br />SECTION I. The Common Council hereby confirms its Declaratory Resolution <br />designating the area described herein as an Economic Revitalization Area for <br />the purposes of tax abatement. Such designation is for real property tax <br />abatement only and is limited to two (2) calendar years from the date of <br />adoption of the Declaratory Resolution by the Common Council. <br />SECTION II. The Common Council hereby determines that the property owner <br />is qualified for and is granted real property tax deduction for a period of <br />three (3) years. <br />SECTION III.
