2. Petition of Jose A. and Lydia Pedraza <br />Staff recommends denial of the variance. The County Council is currently considering amending the <br />County Zoning Ordinance to allow domestic chickens to be raised on residential lots of less than 5 acres. <br />The intent of the regulation would be to enable residents to responsibly keep a small number of chickens <br />on a non - commercial basis while limiting the potential adverse impacts of the surrounding properties.The <br />County Health Department would recommend the following requirements be included in any ordinance <br />revision: <br />• a minimum of 2 acres; <br />• a limit of 6 birds per 2 acres; <br />• weekly cleaning of pens and coops; <br />• weekly manure removal; <br />• no storage of manure on site; <br />• no application of manure on site; <br />• 50' setback for all pens and coops; <br />In addition, staff would likely recommend that the ordinance only allow hens and not allow roosters. <br />Guidelines for the management of livestock exist not only for nuisance control, but also to prevent the <br />spread of disease. <br />Staff observed approximately 45 coops placed along the property line of the nearest residential neighbor. <br />Approximately 48 roosters and 0 hens are on premise. Based on the standards the County may consider, <br />this property would not be allowed chickens, since it only has 1.41 acres, and has only roosters and no <br />hens. <br />6. Petition of Sidney A. and Nancy J. Shafer <br />if the variance is granted, staff recommends it be subject to the remainder being platted as an outlot on a <br />recorded subdivision. <br />7. Petition of Donald F. and Barbara E. Stuber <br />If the variance is granted, staff recommends it be subject to the remainder being platted as an outlot on a <br />recorded subdivision. <br />S. Petition of Somachini North America, LLC <br />Staff recommends denial of the parking island variance. There is no practical difficulty for this variance. <br />Ample room exists for the petitioner to build the landscaped parking islands that the ordinance would <br />require. <br />Special Exception / Special Use <br />A special exception use /special use may only be granted upon making a written determination and <br />adopting appropriate Findings of Fact, based upon the evidence presented at a public hearing, that.. <br />(I) The proposed use will not be injurious to the public health, safety, comfort, community moral <br />standards, convenience or general welfare; <br />(2) The proposed use will not injure or adversely affect the use of the adjacent area or property <br />values therein; <br />(3) The proposed use will be consistent with the character of the district in which it is located and <br />the land uses authorized therein; <br />(4) The proposed use is compatible with the recommendations of the Comprehensive Plan. <br />SERVING ST.
