RESOLUTION NO.: ) ?96— i 1 <br />A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND <br />AUTHORIZING THE EXECUTION OF AN AGREEMENT FOR HAZARDOUS MATERIAL <br />INCIDENT RESPONSE SERVICES BETWEEN THE CITY OF SOUTH BEND <br />AND THE INDIANA DEPARTMENT OF TRANSPORTATION <br />WHEREAS, the Common Council of the City of South Bend recognizes <br />the existence of the South Bend Fire Department Hazardous Materials <br />Incident Response Team consisting of trained personnel and equipment <br />for response to hazardous materials incidents; and <br />WHEREAS, because of continued increase in vehicular traffic <br />transporting hazardous materials on the Toll Road, the Indiana <br />Department of Transportation wishes to continue to receive the <br />services of the South Bend Fire Department Hazardous Materials <br />Incident Response Team for response, assessment and control of <br />hazardous materials incidents occurring within its jurisdiction; and <br />WHEREAS, I.C. 36 -1 -7 -1 et seq. permits governmental entities to <br />exercise powers jointly by entering into a written agreement; and <br />WHEREAS, on June 26, 1991, the Board of Public Safety reviewed <br />this request of the Indiana Department of Transportation, and <br />recommends that the Common Council approve the renewal of an <br />Agreement for Hazardous Materials Incident Response Services with the <br />Indiana Department of Transportation, Toll Road Division. <br />NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City <br />of South Bend, Indiana, as follows: <br />SECTION I. That the Common Council of the City of South Bend renew <br />the Agreement with the Indiana Department of Transportation for <br />Hazardous Materials Incident Response Services and the Mayor be <br />authorized to execute the appropriate Agreement necessary to carry <br />out the request of the Indiana Department of Transportation and <br />intent of this resolution. <br />SECTION II.
