SECTION I. INTRODUCTION <br />A. General <br />This Fiscal Plan represents the City of South Bend's (hereinafter, <br />"City ") policy for the annexation of property in Clay Township, St. <br />Joseph County (hereinafter, "Annexation Area "), and was developed <br />through the cooperative efforts of the Area Plan Commission of St. <br />Joseph County and the following City Departments: <br />Legal Depa <br />Department <br />Department <br />South Bend <br />South Bend <br />Department <br />Department <br />Department <br />rtment <br />Of Public Works <br />of Public Parks <br />Fire Department <br />Police Department <br />of Code Enforcement <br />of Economic Development <br />of Administration and Finance <br />The ordinance for annexation into the City was submitted to the <br />City Clerk's office on April 8, 1992 and received first reading by <br />the Common Council on April 13, 1992. <br />B. Effective Date <br />The approximate date for the annexation to be effective is July 17, <br />1992, after proper publication, notice and recordation as required <br />by state law. An annexation schedule can be found in the Appendix, <br />on Table 1. <br />C. Previous Annexations <br />The Annexation Area is part of a larger area previously considered <br />for annexation under Bill# 44 -91. Bill# 44 -91 was introduced on <br />July 8, 1991 and was subsequently withdrawn. <br />Previous to Bill# 44 -91, Ordinance #5339 was filed in 1971 to annex <br />950 acres of what is commonly called the Maple Lane area. This <br />annexation attempt encompassed an area between the current city <br />limits on the south; Ivy Road, Douglas Road and Ironwood Road on <br />the west; the Toll Road on the north; and the Hickory Road <br />extension line on the east. <br />D. Need For Annexation of Area <br />The territory sought to be annexed (the Annexation Area) is needed <br />and can be used by the City for its development in the reasonably <br />near future. In April of 1989, the Area Plan Commission prepared <br />the "Cleveland Road /State Road 23 Corridor Analysis ". In this <br />report, the Commission recommended that the State Road 23 corridor <br />remain essentially residential with the exception of two areas with <br />the potential for office and multi - family use (see Map 3).
