RESOLUTION NO. /9/ -YA <br />A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, ADDRESSING THE AMERICANS WITH DISABILITIES ACT <br />WHEREAS, there are approximately 43 million persons with physical or mental <br />disabilities living in the United States; and <br />WHEREAS, approximately ten percent of persons between the ages of 18 and 64 <br />are disabled with sixty -seven percent of those individuals being unemployed; and <br />WHEREAS, the first phase of the Americans With Disabilities Act will take effect <br />on January 26, 1992; and <br />WHEREAS, the City of South Bend has appointed an Americans With Disabilities <br />Act Committee to represent all of the major departments, bureaus, and other agencies of the <br />City to assist with the administration of the ADA; and <br />WHEREAS, the Common Council acknowledges that Title II of the ADA requires <br />that the City designate at least one (1) responsible employee to coordinate compliance with <br />the Americans With Disabilities Act; and <br />WHEREAS, the City acknowledges that this new federal law provides <br />comprehensive civil rights protections to individuals with disabilities in the areas of <br />employment, public services, public accommodations, and services operated by private <br />entities and telecommunications. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE <br />CITY OF SOUTH BEND, INDIANA, as follows: <br />SECTION I. The Common Council and the Mayor of the City of South Bend, <br />Indiana pursuant to the Americans With Disabilities Act hereby commit the City to do all <br />that is reasonably necessary to meet the compliance requirements of the Americans With <br />Disabilities Act (ADA). <br />SECTION 1I. The City hereby designates and makes available to the public the <br />name, office address, and office telephone of the "responsible employee" who will <br />coordinate compliance with the Americans With Disabilities Act for the City of South Bend: <br />Jeffrey M. The City wishes to acknowledge publicly the pro bono assistance <br />provided by the Law Firm of Barnes & Thornburg through it's attorney Adam A. Milani, <br />who has assisted Don Fozo,the Building Commissioner for the City of South Bend and St. <br />Joseph County, and John Embrickson, the "responsible employee" for ADA compliance <br />for St. Joseph County; as we work together to meet all of those compliance requirements of <br />the Americans With Disabilities Act. <br />SECTION IV.
