ORDINANCE N0. 3139 AN ORDINANCE REPEALING PARTS OF ORDINANCE NUMBER 2851 AND PARTS OF ORDINANCE NUMBER 2913. WHEREAS on the 14th day of April 1930, the Common Council of the City of South Bend, State of Indiana, passed ordinance Number 2851, confirming and radifying Board of Public 'forks Grade Separation Resolution Number 5, as modified, which provided for grade separation at certain crossings, and altering of the grades at other crossings, by the New York Central Railroad Company, the Grand 'Trunk Western Railroad Company, an" the New Jersey, Indiana and Illinois Railroad Company: and WHEREAS, on the 12th day of January 1931, Ordinance Number 2913 was passed by the Common Council of the City of South Bend, providing when the grade separation and alteration provided for by Ordinance 2851 shall be begun and finished: and WHEREAS, on the 16th day of April 1934, the Common Council of the 6ity of South Bend, ratified and confirmed by Ordinance number 3053, agreements by and between The New York Central Railroad Company, the Municipal City of South Bend by and through its Board of Public Works, and the State highway Commission of the State of Indiana which said agreements provided for grade separation at Walnut and Western Avenue, in said City of South Bend: and WHEREAS, the grade separation provided for by the agreements ratified and confirmed by Ordinance 3053 has now been fully completed; therefore Indiana: BE IT ORDAINED by the Common Council of the City of South Bend, SEOTION I, That such parts of Ordinance Number 2851 as relate to grade separation and / or alteration by The New York Central Railroad Company be and the same are hereby repealed.
