T a n„ ~ r ~, ~ G. 20 ~ ~ City Clerk RESOLUTION NO. 3 tO~-~ A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF SOUTH BEND, INDIANA, COMMONLY KNOWN AS 4440 NORTH PORTAGE ROAD AS AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF A (5) FIVE-YEAR REAL PROPERTY TAX ABATEMENT FOR THE SOUTH BEND CLINIC WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a Declaratory Resolution designating certain areas within the City as Economic Revitalization Areas for the purpose of tax abatement consideration; and WHEREAS, a Declaratory Resolution designated the area commonly known as 4440 North Portage Road, South Bend, Indiana, and which is more particularly described as follows: THAT PART OF A TRACT OF (13) THIRTEEN ACRES OFF THE NORTH END OF A (25) TWENTY-FIVE ACRE TRACT OFF THE NORTH END OF THE WEST HALF (1/2) OF THE NORTHWEST QUARTER (1/4) OF SECTION (22) TWENTY-TWO, TOWNSHIP (38) THIRTY- EIGHT NORTH, RANGE (2) TWO EAST, WHICH LIES EAST OF THE HIGHWAY KNOWN AS THE PORTAGE PRAIRIE ROAD and which has Key Number 004-1014-0217, as an Economic Revitalization Area; and WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing before the Council has been published pursuant to Indiana Code 6-1.1-12.1-2.5; and WHEREAS, the Council held a public hearing for the purposes of hearing all remonstrance's and objections from interested persons; and WHEREAS, the Council has determined that the qualifications for an economic revitalization area have been met. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. The Common Council hereby confirms its Declaratory Resolution designating the area described herein as an Economic Revitalization Area for the purposes of tax abatement. Such designation is for Real property tax abatement only and is limited to two (2) calendar years from the date of adoption of the Declaratory Resolution by the Common Council. SECTION II. The Common Council hereby determines that the property owner is qualified for and is granted Real property tax deduction for a period of (5) years, and further determines that the petition, the Memorandum of Agreement between the Petitioner and the City of South Bend, and the Statement of Benefits comply with Chapter 2, Article 6, of the Municipal Code of the City of South Bend and Indiana Code 6-1.1-12 et sea. SECTION III. The applicant is asking for a special exception because the project does not meet the general standards for real property tax abatement set forth in Chapter 2, Article 6, Section 2-77 through 2-83.3 of the Municipal Code of the City of South Bend. Pursuant to Chapter 2, Article 6, Section 2-82 of the Municipal Code, this petition was referred to the Department of Community and Economic Development for purposes of investigation and preparation of a report determining whether the azea qualifies as an Economic Revitalization Area pursuant to I.C.6-1.1-12.1 and whether all zoning requirements have been met. The Department of Community and Economic Development has reviewed the petition (a copy of which is attached), investigated the area, and makes the following report. PROJECT SUMMARY The South Bend Clinic proposes to develop a vacant, undeveloped lot into a branch campus for primary medical care services. The company plans to construct a 1'/2 story, 13,874 square foot medical office building with a 102-space paved surface parking lot. The estimated cost of the addition is $2,943,000. It would be the staff's recommendation to make the project eligible fora (5) five-year real property tax abatement. Total taxes to be abated during the (5) five-year abatement period are estimated at $301,782. Total taxes to be paid during the (5) five-year abatement period are estimated at $201,188. EMPLOYMENT IMPACT Per the petition, it is estimated that the total project will create (1) one new, permanent, full-time job and (2) two permanent, part-time jobs within the first year representing a new annual payroll of $66,705. The project will also maintain (19) nineteen existing, permanent, full-time jobs and (7) seven, permanent, part-time jobs representing an annual payroll of $600,000. ABATEMENT QUALIFICATION 1. A review of the tax abatements previously granted, finds that the petitioner has not been granted or associated with any previous tax abatements. 2. The Building Commissioner has reviewed the petition and finds the property to be properly zoned for the proposed project. 4. A review of the Tax Abatement Ordinance No. 9394-03 finds that the petitioner does not meet the qualifications for a real property tax abatement. CITY OF SOUTH BEND PETITION FOR REAL PROPERTY TAX ABATEMENT CONSIDERATION The undersigned owner(s) of real property, located within the City of South Bend, hereby petition the Common Council of the City of South Bend for real property tax abatement consideration and pursuant to I.C. 6-1.1-12 1-1, et sec ., and South Bend Municipal Code Section 2-76, et sec ., for this petition states the following: Describe the proposed redevelopment or rehabilitation project, including information about physical improvements to be made, the proposed use of the improvements, and a general statement as to the importance of the project to your business. The proposed project will convert a current vacant, undeveloped lot into a campus for primary medical care services. The western portion of the land will be developed with a 1.5 story 13 874 gross square foot medical office that will offer the services of up to eight physicians specializing in family medicine and internal medicine. Parking space will consist of 102 paved surface parking spaces. Primary campus access will be from Brick Road. Comprehensive landscaping will be undertaken so as to present a community based, residential medical office complementing area conditions, while the balance of the property which will be undeveloped and available for future use will be seeded with natural wildflowers and grasses. Describe the overall nature of the business and of the operations occurring at the Property (Please attach additional sheet if more space is needed): The medical office will offer the services of up to eight physicians specializing in family medicine and internal medicine. Supporting the physicians will be a complement of on-site diagnostic services including plain film radiography, screening mammography and basic laboratory services. The physicians will serve a patient population from obstetric and newborn care through children, adolescents adults and the elderly. On site procedural services will include minor office surgery and care of acute inluN, flexible sigmoidoscopy, primary dermatologic services, routine fracture care, and complete physicals and preventative medicine services. Subsequent to market analysis and assessment, the Clinic identified the northwest portion of the City as a medically underserved area, one which the Clinic had a material number of patients who accessed its services but drove to its other facilities for care, and one which is undergoing and projected to continue with significant residential and commercial property development and population growth . With expansion of the Clinic's services at its downtown campus and growth of its physician population and capacity to serve at that location, it was determined that two current satellite offices of primary care physicians also in the downtown area could be relocated to better serve their patient base, and better address demographic growth patterns in the region. These two current satellite offices are located in property the Clinic leases from independent third parties, and with the proposed project, will be relocated to a new facility owned and developed by the Clinic through one of its wholly owned real estate entities. The Clinic has and will continue to be afor-profit, tax paying entity. While temporary tax abatement is being requested, the incremental effect of the Clinic's relocation of current offices, and expansion of facilities will result in an incremental tax base for the City. The land on which the development is proposed is located on an approximate 13-acre parcel on the southeast corner of Portage and Brick roads. Acquired by the Clinic in late 2005, the Clinic sought and was successful in its initiative to have the land annexed to the City of South Bend. Concurrent with property development, the Clinic will enter into a 50:50 shared venture with the City to share the cost~of utility (sewer and water) extensions north on Portage Ave to the Clinic's property. With expansion on the northwest side of town, the Clinic's satellite offices current and new satellite offices provide primary care medicine and services to the area's population in both suburban and urban center city areas. The satellite suburban locations serve as cost effective sources of primary care, while also acting as referral sources to the Clinic's main hub at its downtown campus. When patients are determined to need more complex diagnostic or treatment services, or Exhibit D , referral to a subspecialty physician, physicians in these satellite locations have access to the more comprehensive services of the Clinic located at its downtown campus. The proposed project will at inception, relocate three physician and their support staff from their current downtown satellite office. The Clinic will retain the office being vacated by these physicians as space for a fourth physicians currently practicing, and room for downtown subspecialty growth. Subsequently, after approximately six months, a second downtown satellite office of four physicians will be relocated along with their support staff. In contrast to the first relocation, this second office will be fully vacated by the Clinic, and available for its lessor to re-lease to a new tenant.
