RESOLUTION NO. tai <br />A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY <br />RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF <br />SOUTH BEND, INDIANA, COMMONLY KNOWN AS <br />THE SOUTHEAST CORNER OF IRELAND AND MIAMI ROADS <br />SOUTH BEND, INDIANA TO BE AN ECONOMIC <br />REVITALIZATION AREA FOR PURPOSES OF A TEN YEAR REAL <br />PROPERTY TAX ABATEMENT FOR <br />MASSACHUSETTS MUTUAL LIFE INSURANCE COMPANY /SCOTTSDALE MALL <br />WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a <br />Declaratory Resolution designating certain areas within the City as Economic Revitalization <br />Areas for the purpose of tax abatement consideration; and <br />WHEREAS, a Declaratory Resolution designated the area commonly known as the <br />Southeast corner of Ireland and Miami Roads, South Bend, Indiana and which is more <br />particularly described as follows: <br />A parcel of real estate in the County of St. Joseph State of Indiana and <br />described as follows: <br />A parcel being part of the North Half of the Southwest Quarter of Section 30, <br />Township 37 North, Range 3 East, City of South Bend, Centre Township, St. <br />Joseph County, Indiana, described as follows: Commencing at the Northwest <br />corner of said quarter; thence South 89 °54'37" East (bearing assumed) along <br />the North line of said quarter, a distance of 260.00 feet to the point of <br />beginning; thence continuing along said North line, a distance of 1052.00 feet, <br />thence South 00 °05'11" West, a distance of 870.00 feet; thence North <br />89 °59'16" East, a distance of 53.00 feet; thence South 00 °04'32" West, a <br />distance of 150.00 feet; thence South 89 055'20" East, to the West line of <br />Scottsdale Addition, Section "A ", a distance of 484.86 feet; thence South <br />00 °25'08" East, along said West line to the North right -of -way of U.S. Route <br />20 bypass, a distance of 156.52 feet; the next (8) calls being on the North said <br />right -of -way; thence Deed; South 69 °58'00" West, a distance of 421.39 feet, <br />(measured: South 70 °28'36" West, 313.64 feet and South 70 027'31" West, <br />106.22 feet) to the South line of said North Half; thence along said North <br />line, North 89 052'45" West, a distance of 1397.83 feet; thence North 0 005'50" <br />East, along the East side of a tract purchased by I.D.O.T. for right -of -way, a <br />distance of 788.54 feet; thence North 89 027'44" West, to the East right -of -way <br />line (county), a distance of 19.84 feet; thence along the said East right -of -way <br />line South 0 004'21" East, a distance of 788.69 feet; thence North 89 °52'45" <br />West, a distance of 40.00 feet to the West line of said quarter section; thence <br />North 00 000'00" East, along said West line, a distance of 1046.67 feet; thence <br />Deed: South 89 054'26" East, a distance of 260.00 feet, thence North 00 °00'00" <br />East, a distance of 270.00 feet to the point of beginning. <br />with said real estate having the following Key Nos. 231009 - 0582.231009- 0582B. and 231009 - <br />0582C, as an Economic Revitalization Area; and <br />WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing <br />before the Council has been published pursuant to Indiana Code 6 -1.1- 12.1 -2.5; and <br />WHEREAS, the Council held a public hearing for the purposes of hearing all remonstrances <br />and objections from interested persons; and <br />
