ORDINANCE NO 3 '5Z& <br />AN ORDINANCE AUTHORIZING THE SALE OF <br />STREET CAR TRACKS, South Bend, Indiana. <br />WHEREAS, the city of South Bend, Indiana, and the North- <br />ern Indiana Transit, Inc., have entered into a contract for the <br />substitution of bus service for street car service in the city of <br />South Bend, and <br />WHEREAS, by the terms of said contract the Northern <br />Indiana Transit Inc., gave to the city of South Bend, steel rails <br />constitutiong the tracks of their street car lines, and <br />WHEREAS, it is desirable to remove said rails from the <br />streets and dispose of them as rapidly as possible in order that <br />the streets may be reconditioned in the track areas, <br />NOW THEREFORE, BE IT ORDAINED by the Common Council of <br />the City of South Bend, Indiana. <br />Section 1. That the Mayor and Board of Public Works and <br />Safety are hereby authorized and empowered to sell all rails which <br />constituted the tracks of the former street car system of the city <br />of South Bend, and also the rails on that portion of the Notre Dame <br />line which lie outside of the city of South Bend; said sale to be <br />made only after the Circuit Court Judge has appointed three disin- <br />terested citizens of the city of South Bend, Indiana, to appraise <br />said property, and afterthe report of said appraisers has been made <br />and filed with the B oard of Public Works and Safety, and said prop- <br />erty shall be sold for not less than the full appraised value as the <br />same is determined by said appraisers. <br />Section 2. Said propetty may be sold by the Mayor and <br />the Board of Public Works and Safety in bulk, in sections or on a <br />tonnage basis, or in any manner which is deemed to be to the best <br />advantage of the city. <br />k1,A.2nd READING �/ }5��� 0 <br />Section 3.
