<br />A RESOLUTION CONFIRMING THE ADOPTION OF A
<br />DECLARATORY RESOLUTION DESIGNATING
<br />CERTAIN AREAS WITHIN THE CITY OF SOUTH BEND,
<br />INDIANA, COMMONLY KNOWN AS 322 E. COLFAX
<br />AVENUE TO BE AN ECONOMIC REVITALIZATION
<br />AREA FOR PURPOSES OF A TEN (10) YEAR
<br />REAL PROPERTY TAX ABATEMENT FOR
<br />THE SOUTH BEND REDEVELOPMENT COMMISSION ON
<br />BEHALF OF RKE, INC. (DBA: STEPHENSON MILL, INC.)
<br />WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a
<br />Declaratory Resolution designating certain areas within the City as Economic Revitalization
<br />Areas for the purpose of tax abatement consideration; and
<br />WHEREAS, a Declaratory Resolution designated the area commonly known as 322 East
<br />Colfax Avenue and which is more particularly described as follows:
<br />Parcel "A ":
<br />That part of the Northeast Quarter of Section 12, Township 37 North, Range 2 East, Portage
<br />Township, City of South Bend, St. Joseph County, Indiana which is described as: Beginning
<br />at the intersection of the South right -of -way line of Colfax Avenue and the West right -of -way
<br />line of Gintz Avenue which point is West 256.3 ft. from an iron set for the Southwest corner
<br />of Niles Avenue and Colfax Avenue; thence South 050- 53' -22" East along said West right -of-
<br />way line, 274.37 ft. (Record, South 05 ° -31' West, 274.4 ft.); thence North 89 °- 58' -48"
<br />West, 167.91 ft. (Record, West 167.9 ft.); thence North 150- 07'45" West, 87.70 ft. (Record,
<br />North 15 ° -6' West); thence North 87 °- 52' -06" East, 47.34 ft. (Record, N. 890-47' East
<br />47.25 ft.); thence North 00 °- 56' -55" West, (Record, North 000-56' West 188.2 ft.) to the
<br />South right -of -way line of Colfax Avenue; thence South 890- 54' -00" East along said South
<br />right -of -way line, (Record, East 118.48 ft.), 118.42 ft. to the point of beginning. Containing
<br />0.8877 Acres. Subject to all legal highways, easements and restrictions of record.

<br />That part of the Northeast Quarter of Section 12, Township 37 North, Range 2 East, Portage
<br />Township, City of South Bend, St. Joseph County, Indiana which is described as: Beginning
<br />at a point on the West right -of -way line of Gintz Avenue which point is 273.00 ft. South of
<br />the South right -of -way line of Colfax Avenue, measured at right angles to said south right -of-
<br />way line; thence South 05 °- 53' -22" East along said Gintz Avenue right -of -way line and its
<br />extension, (Record, South 05 °- 27' -44" East), 152.28 ft.; thence North 89°-58' -
<br />48"West,149.14 ft.; thence North 24 °- 37' -29" West, 166.65 ft.; thence South 890- 58' -48"
<br />East, 202.95 ft. to the point of beginning. Containing 0.6121 acres. Subject to all legal
<br />highways, easements and restrictions of record.
<br />with said real estate having the following Key No.: 18 -5001 -0007, as an Economic
<br />Revitalization Area; and
<br />WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing before
<br />the Council has been published pursuant to Indiana Code 6- 1.1- 12.1 -2.5; and
<br />WHEREAS, the Council held a public hearing for the purposes of hearing all remonstrances
<br />and objections from interested persons; and
<br />WHEREAS, the Council has determined that the qualifications for an economic revitalization
<br />area have been met.
<br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South
<br />Bend, Indiana, as follows:
