A RESOLUTION OF THE COMMON COUNCIL
OF THE CITY OF SOUTH BEND ADOPTING A
WRITTEN FISCAL PLAN AND ESTABLISHING
POLICY FOR THE PROVISION OF A
SERVICES TO ANNEXED AREA
(RESERVOIR ANNEXATION)
WHEREAS, there has been submitted to the Common Council of the
City of South Bend, Indiana, a substitute ordinance which proposes the
annexation of the hereinafter described real estate located in Centre
Township, St. Joseph County, Indiana; and
WHEREAS, the territory proposed to be annexed encompasses an
operating City reservoir, residential properties, a church, and
commercial and mixed -use property located in Centre Township, St.
Joseph County, contiguous therewith and generally located west of
Ironwood Road, and south of Ireland Road. The development of the
territory proposed to be annexed will require a basic level of
municipal public services, which services shall include services of a
non - capital nature, including street and road maintenance, and
services of a capital improvement nature, including street
construction, street lighting, sewer facilities, and storm water
facilities; and
WHEREAS, the Common Council of the City of South Bend, Indiana
now desires to establish and adopt a fiscal plan and establish a
definite policy showing (1) the cost estimates of services of a
non - capital nature, including street and road maintenance, police and
fire protection and other non- capital services normally provided
within the corporate boundaries, and services of a capital improvement
nature, including street construction, street lighting, water
facilities, sewer facilities, and storm water drainage facilities to
be furnished to the territory to be annexed; (2) the method(s) of
financing those services; (3) the plan for the organization and
extension of those services; (4) that services of a non - capital nature
will be provided to the annexed area within one (1) year after the
effective date of the annexation, and that they will be provided in a
manner equivalent in standard and scope to similar non - capital
services provided to areas within the corporate boundaries of the City
of South Bend, that have characteristic of topography, patterns of
land use, and population density similar to that of the territory to
be annexed; (5) that services of a capital improvement nature will be
provided to the annexed area within three (3) years after the
effective date of the annexation in the same manner as those services
are provided to areas within the corporate boundaries of the City of
South Bend that have characteristics of topography, patterns of land
use and population density similar to that of the territory to be
annexed and in a manner consistent with federal, state and local laws,
procedures, and planning criteria; and (6) the plan for hiring the
employees of other governmental entities whose jobs will be eliminated
by the proposed annexation; and
WHEREAS, the Board of Public Works of the City of South Bend, the
Board of Public Safety of the City of South Bend, and the Board of
Water Works Commissioners of the City of South Bend have approved a
written fiscal plan and established a policy for the provision of
services to the territory to be annexed which plan and policy, as it
relates to the territory to be annexed, the Common Council finds to be
in the best interests of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY
OF SOUTH BEND, INDIANA, AS FOLLOWS:
Section I. That it is in the best interest of the City of South
Bend and of the area proposed to be annexed that the real property
located in Centre Township, St. Joseph County, Indiana, described in
Exhibit "A," attached hereto and made a part hereof, be annexed to the
City of South Bend.
Section II. That it shall be and hereby is now declared and
established that it is the policy of the City of South Bend to furnish
to said territory services of a non - capital nature, such as street and
road maintenance, police and fire protection, within one (1) year of
the effective date of the annexation, in a manner equivalent in
standard and scope to the services furnished by the City to other
areas of the City which have characteristics of typography, patterns
of land utilization and population density similar to said territory;
and to furnish to said territory services of a capital improvement
nature, such as street construction, street lighting, water
facilities, sewer facilities, and storm water facilities -, within three
(3) years of the effective date of the annexation, in the same manner
as those services are provided to areas within the corporate
boundaries of the City of South Bend that have characteristics of
topography, patterns of land use and population density similar to
that of the territory to be annexed and in a manner consistent with
federal, state and local laws, procedures -, and planning criteria.
Section III. That the Common Council of the City of South Bend
shall and does hereby now establish and adopt the fiscal plan,
attached hereto and made a part hereof, for the furnishing of said
services to the territory to be annexed.
Section IV. This Resolution shall be in full force and effect
upon its adoption by the Common Council and approval by the Mayor.

SECTION I. INTRODUCTION
A. General
This Fiscal Plan represents the City of South Bend's (hereinafter, "City ") policy for the
annexation of property in Centre Township, St. Joseph County (hereinafter, "Annexation
Area "), and was developed through the cooperative efforts of the Area Plan Commission
of St. Joseph County and the following City Departments:

B. Effective Date
The anticipated date for the annexation to be effective is April 1, 1994 after proper
publication, notice and recordation as required by state law. An Annexation Schedule,
designated as Table 1, can be found in the Appendix.
C. Previous Annexations
Previous annexations border the Annexation Area on the East, South, and West, and
North:
■ Ordinance 8001 -89 on the East.
■ Ordinances 4295 -60 and 4628 -64 on the West and South .
■ Ordinances 7979 -89, 7993 -89, and 6000 -76 on the North.
D. Ownership
Tax records maintained by the St. Joseph County Auditor's office indicate the primary
owners of the properties within the Annexation Area are:

SECTION H. GENERAL DATA
A. Location and Access
The Annexation Area is generally located west of Ironwood Road, and south of Ireland
Road in unincorporated St. Joseph County. It is bordered by the Scottsdale Subdivision
on the west, and on the south by the U.S. 31 Bypass. A Vicinity map (Map 1) and an
Annexation Area map (Map 2) can be found in the Appendix.
B. Legal Description
The Annexation Area is part of the Southeast quarter of Section 30, Township 37 North,
Range 3 East, Centre Township, St. Joseph County, Indiana. A complete legal description
for the Annexation Area can be found in the Appendix, on Table 2.
C. Contiguity
The Annexation Area is at least one - eighth 1/8 (12.5 %) contiguous to the South Bend City
limits:

D. Size and Topography
The size of the Annexation Area is approximately 32 acres, determined by metes and
bounds calculations. The Area is flat to moderately sloping.
E. Population and Density
The Annexation Area is part of Census Track 118, Block 101C. 1990 Census data indicates
four housing units and a total population of ten. The Annexation Area consists of most
of Block 101C. The remainder of Block 101C consists of Franks Nursery and Teachers
Credit Union which confirms the census data.
A visual survey of the Annexation Area was conducted. Based on this survey, there are
four housing units, one church and one medical office. The Annexation Area has a density
of .31 persons per acre (10 persons /32 acres).

F. Buildings and Land Use
A visual survey of the Annexation Area was conducted. An operating City water reservoir
is located just south of the U.S. 20 Bypass in the southwestern corner of the Annexation
Area. Also included in the Annexation Area is an access road that once lead to the water
tank from Ireland Road but has since been terminated at its south end by the
development of the Bypass.
The United Pentecostal Church is located in the Annexation Area. The church, a related
multi - purpose shed, and church parking are located on a four acre parcel that fronts
Ireland Road. There is also a residential structure adjacent to the church on a separate lot
that is presently used as the pastor's residence.
There are three additional single - family housing units, one single - family
residential /commercial mixed use structure, and one medical office.
A strip of land used by the Indiana Michigan Power Company for their power lines and
Ireland Road Station is also located within the Annexation Area. Public right of way on
both Ireland and Ironwood Roads is included in the Annexation Area as well.
G. Zoning
The Annexation Area is zoned primarily "R" Residential with one parcel zoned "O" Office
under the St. Joseph County Zoning Ordinance. Upon annexation, the annexed area will
automatically be zoned "A" Residential, "A" Height and Area, per the requirements of
Chapter 21 of the Municipal Code of the City of South Bend. Upon annexation existing
uses shall be classified as either legal uses under the "A" Residential zoning classification,
or as legal non - conforming uses under the "A" Residential zoning classification.
Upon notification of the annexation, The Area Plan Commission of St. Joseph County may
recommend to the South Bend Common Council a zoning classification other than "A"
Residential.
H. Tax Rate
Tax rate information is based upon published tax rates for tax year 1992 payable in 1993.
Tax rates may, and generally do, change every year. Depending upon the effective date
of the annexation, the rates used here may no longer be applicable.
The City of South Bend will be providing fire service upon incorporation of the
Annexation Area. Therefore, it is estimated that the Township Rate will decrease by
$0.4952 per $100.00 of assessed valuation with the deletion of the Fire Fighting Fund,
Cumulative Fund and the Fire Debt Fund.

It is estimated that the tax rate for the Annexation Area will increase by $5.9126 per
$100.00 of assessed valuation with the addition of the City and Town Rate, the
Redevelopment District Rate and the South Bend Transpo Rate.
The net increase in property taxes are estimated to be $5.4174 per $100.00 of assessed
valuation. Table 3 in the Appendix shows the current, representative tax rate information
as published by the St. Joseph County Auditor.
L Assessments
The following net assessments in the Annexation Area are from the 1992 payable 1993
property tax records:
Real Property $269,680.00
Personal Property 0.00
TOTAL $269,680.00
Property tax records indicate that the total tax bill, payable in 1993, for all properties
involved within the Annexation Area, is $19,813.74.
Assuming that factors remain constant, the total tax bill for the same properties upon
incorporation would be approximately $31,583 an increase of about $11,770 or 62.7 %.
J. Councilmanic District
The Annexation Area will be assigned to Councilmanic District 5.
K. Comparable Area
One of the requirements of the Fiscal Plan is to show that the Annexation Area will
receive services in a manner equivalent in standard and scope to services provided to
areas within the City that have similar topography, patterns of land use, and population
density.
The Comparable Area for this Fiscal Plan is generally located north of Ireland Road, east
of York Road, and west of Ironwood Road. The area is flat to moderately sloping. The
area contains several structures; two single - family residences; one medical office; one
insurance office; and a church.

Service delivery by the respective City agencies and departments, as set forth below, is
expected to be fully provided to the Annexation Area at the same level of service as is
currently being provided to the Comparable Area.
Police Protection, Fire Protection, Code Enforcement, and Administrative Services are
being provided to the Comparable Area to the same extent that they will be provided to
the Annexation Area.
Public works services, such as, sanitary sewer and water are also being provided to the
Comparable Area to the same extent that they are currently provided to the Annexation
Area.
L. Hiring Plan
It is anticipated that this annexation will not result in the elimination of jobs for
employees of other governmental units, although the City is not required to hire any
employees whose jobs have been eliminated by an annexation.

SECTION III. MUNICIPAL SERVICES
A. Public Works
Of the known buildings within the Annexation Area four are receiving City water and
sewer service, and two are utilizing private wells and septic systems:
O1- 1019 -0425: city water /sewer- since 1987 (church 53609 S. Ironwood);
01- 1019- 0425.11: city water /sewer- since 1987 (residence - rectory 59633 S. Ironwood);
01- 1019 - 0425.05: city water /sewer- since 1985 (residence 18196 W. Ireland);
01- 1019 - 0425.07: city water /sewer- since 1966 (residence 18210 W. Ireland);
01- 1019 - 0425.08: private well /septic (medical office 18232 W. Ireland);
O1- 1019 - 0425.04: private well /septic (residence 59601 S. Ironwood);
City sanitary sewer and water are available to the annexation Area. The Department
of Public Works does not anticipate any additional cost to provide services to the
Annexation Area.
The subject area is surrounded by water mains. A 20" line is located on the west
boundary within the access road leading to the city reservoir situated in the
southwestern corner of the site. A 16" water main is also located along Ireland Road.
There are 12" mains located along the south and east (Ironwood Road) boundaries. No
expense for water service is anticipated and all water mains are available to the
Annexation Area.
A 24" sanitary sewer abuts the Annexation Area, located in the Ironwood Road right -
of -way. A 8" sanitary sewer abuts the properties along Ireland Road.
The Ireland Road segment was extended to the west property line of parcel number
O1- 1019 - 0425.07 (residence 18210 W. Ireland) from Ironwood Road. These sewers are
capable of handling any future development within the Annexation Area.
Extensions of, or taps into sanitary sewer and water lines shall be governed by I.C. 36-
9-22-2, I.C. 8 -1.5 -3 and -4, and the rules and regulations of the South Bend Water
Works and Sewer Utility.
All additional public works services, such as maintenance of existing or future streets,
are capable of being provided to this site.
A 16" water line is located in the Ireland Road right -of -way. 8" and 6" lines are
located along a portion of Sampson Street. These lines currently provide water service
to the Comparable Area.

Department of Code Enforcement will provide services to the Annexation Area
without any additional expenses over the present budget.
The Comparable Area is located within City Code Enforcement Area 5 and is currently
being provided code enforcement services by Inspector #5 at a level comparable to
other areas of the city.
E. Administrative Services
The incorporation of the Annexation Area will not effect the provision to the
Annexation Area of other services currently provided on a county -wide basis. The St.
Joseph County Health Department, The Humane Society of St. Joseph County, the St.
Joseph County Public Library, the Area Plan Commission and the St. Joseph
County/South Bend Building Department are some of the county-wide agencies that
will continue to provide the same type and level of services to the Annexation Area
currently available to it now.
Other City agencies such as the Park Department, the Department of Economic
Development, the Department of Administration and Finance and the Legal
Department, will also be in a position to provide appropriate service to the Annexation
Area at the same level as is currently being provided to other areas of the City.
The provision of services on a county-wide basis are currently available to the
Comparable Area. Other City agencies such as the Park Department, Department of
Economic Developement, the Department of Administration and Finance and the Legal
Department, also provide their services to the Comaprable Area.
SECTION IV. FISCAL IMPACT
The fiscal impact to the City upon annexation of the annexation Area will be minimal.
Improvements of a capital nature will not be necessary to provide comparable services.
Administrative costs, or expenditures of a non - capital nature, will be absorbed by the
normal City budget process.
SECTION V. RECOMMENDATION
This Fiscal Plan shows that the Annexation Area meets the requirements of the laws of
the State of Indiana pertaining to annexation of contiguous property. The issues of
contiguity, percent of the territory subdivided, and a written fiscal plan are provided
within the context of this document.

A 8" sanitary sewer abuts the Comparable Area. This line is located in the Ireland
Road right -of -way and presently provides sewer service to the Comparable Area.
B. Police Department
The Annexation Area is expected to be added to Beat 16. Beat 16 will be expanded to
provide police service. Routine patrol, law enforcement, traffic enforcement and
emergency responses will be provided by the Beat car assigned to the area.
The Annexation Area is not expected to create any unusual problems relative to
patrolling the Area. As the Annexation Area is developed, police resources will be
applied in a manner comparable to all other areas of the City.
No additional capital expenditures will be required to successfully patrol the
Annexation Area.
The Comparable Area is currently served by Police Beat 15. Routine patrol, law
enforcement, traffic enforcement, and emergency responses are presently assigned to
the Beat car utilized in the Comparable Area.
C. Fire Department
The South Bend Fire Department does not foresee any unusual fire protection
problems related to the Annexation Area. The Annexation Area is located
approximately 2 miles from Station #10 located at 308 W. Ireland Road. Additional
fire units would respond including Station #8 located approximately 2 miles away at
2402 Twyckenham Drive.
Response times will be comparable to other areas of the City.
No additional equipment will need to be purchased, or personnel hired, to service the
Annexation Area.
Fire Protection service to the Comparable Area is presently being provided by the
South Bend Fire Department via Station #10 located 2 miles east of the Comparable
Area at 308 W. Ireland Road. If additional service is needed, other units would
respond, including Engine #8, which is also located two miles away at 2402
Twyckenham Drive.
D. Code Enforcement
The Annexation Area is expected to be added to City Code Enforcement Area 5-
Inspector 5. Area 5 will be expanded to provide code enforcement service. The

The Fiscal Plan also shows that the Annexation Area is presently receiving and benefitting
from City services in the form of sewer and water service. This annexation will promote
the delivery of efficient governmental services, and this fiscal plan demonstrates that the
City is physically and financially able to provide municipal services to the territory sought
to be annexed.
It is recommended that this Fiscal Plan be adopted and that the Petition for Annexation
into the City of South Bend be approved. It is also recommended that the Annexation
Area be accepted into the City after passage of the annexation ordinance, approval by the
Mayor, and proper publication and notice.
