RESOLUTION N0. oZI S <i- 9% T <br />A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, AUTHORIZING THE MAYOR TO SUBMIT TO THE UNITED STATES <br />GOVERNMENT, DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD) AN <br />APPLICATION FOR FEDERAL ENTERPRISE COMMUNITY DESIGNATION UNDER <br />TITLE XIII OF THE OMNIBUS BUDGET RECONCILIATION ACT OF 1993 <br />WHEREAS, the Mayor of the City of South Bend, Indiana, is the <br />Chief Executive Officer of the City and is the applicant for <br />Federal Enterprise Community Designation under TITLE XIII of the <br />Omnibus Budget Reconciliation Act of 1993. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the <br />City of South Bend, Indiana, as follows: <br />SECTION I. That the Mayor of the City of South Bend, Indiana, <br />is hereby authorized to submit a Federal Enterprise Community <br />application to the United States Department of Housing and Economic <br />Development under TITLE XIII of the Omnibus Budget Reconciliation <br />Act of 1993. <br />SECTION II. That the Common Council of the City of South Bend, <br />Indiana, hereby requests that the Mayor submit the Enterprise <br />Community Grant application to the Common Council for review and <br />comment prior to the date upon which the application must be filed <br />with the United States Department of Housing and Urban Development. <br />SECTION III. That for every activity, project, or program to <br />be funded through the City of South Bend, the Mayor shall submit to <br />the Common Council an appropriation ordinance prior to expenditure <br />of any United States Department of Housing and Urban Development <br />Enterprise Community grant funds received upon this application. <br />SECTION IV. That the Mayor shall be authorized to accept and <br />affirm the grant award should one be made. <br />SECTION V. That the City's Department of Community and <br />Economic Development be designated as the City of South Bend's <br />coordinating agency and office, and further agrees to advise the <br />Common Council of any not - for - profit agency receiving grant funds. <br />SECTION VI.
