RESOLUTION NO. o2 /3y - JSG <br />A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY <br />RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF <br />SOUTH BEND, INDIANA, COMMONLY KNOWN AS <br />THE NORTHEAST CORNER OF MAIN STREET <br />AND BROADWAY STREET <br />TO BE AN ECONOMIC REVITALIZATION <br />AREA FOR PURPOSES OF A TEN (10) YEAR REAL <br />PROPERTY TAX ABATEMENT FOR RICHARD ALLEN <br />WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a <br />Declaratory Resolution designating certain areas within the City as Economic Revitalization <br />Areas for the purpose of tax abatement consideration; and <br />WHEREAS, a Declaratory Resolution designated the area commonly known as the <br />northeast corner of Main Street and Broadway Street and which is more particularly described <br />as follows: <br />That part of the Northwest Quarter of Section 13, Township 37, North, Range <br />2 East, Portage Township, which is described as: Lots 17, 18, 19 and 20 of the <br />recorded Plat of "Stull's Third Addition to the City of South Bend" as shown <br />in Plat Book #6, on Page #109 in the records of the St. Joseph County, Indiana <br />Recorder's Office and being more particularly described as: <br />Beginning at the Southwest Corner of Lot 20 of the recorded Plat of "Stull's <br />Third Addition to the City of South Bend" as shown in Plat Book #6, on Page <br />#109 in the records of the St. Joseph County, Indiana Recorder's Office said <br />point also being the intersection of the East right -of -way line of Main Street <br />and the North right -of -way line of Broadway Street; thence N. 00 °19'52" W. <br />along said East line, 264.24 ft. (Record, 264.0 ft.) to the Northwest comer of <br />Lot 17 in said Subdivision; thence N. 89 °30'02" E. along the North line of <br />said Lot, 165.70 ft. (Record, 165.75 ft.) to the West right -of -way line of a 14 <br />ft. public alley and the Northeast corner of said Lot 17; thence S. 00 °17'54" <br />E. along said West line, 264.50 ft. (Record, 264.0 ft.) to the North right -of- <br />way line of Broadway Street, and the Southeast corner of said Lot 20; thence <br />S. 89 °35'32" W. along the South line of said Lot and North right -of -way line, <br />165.55 ft. (Record, 165.75 ft.) to the Point of Beginning <br />with said real estate having the following Key No.: 18- 8004 -0209 through 18- 8004 -0215, as <br />an Economic Revitalization Area; and <br />WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing <br />before the Council has been published pursuant to Indiana Code 6- 1.1- 12.1 -2.5; and <br />WHEREAS, the Council held a public hearing for the purposes of hearing all <br />remonstrances and objections from interested persons; and <br />WHEREAS, the Council has determined that the qualifications for an economic <br />revitalization area have been met. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of <br />South Bend, Indiana, as follows: <br />SECTION I. The Common Council hereby confirms its Declaratory Resolution designating <br />the area described herein as an Economic Revitalization Area for the purposes of tax <br />abatement. Such designation is for Real property tax abatement only and is limited to two (2) <br />calendar years from the date of adoption of the Declaratory Resolution by the Common <br />Council. <br />
