RESOLUTION NO. p A M5 <br />A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY RESOLUTION <br />DESIGNATING CERTAIN AREAS WITHIN THE CITY OF SOUTH BEND, INDIANA, <br />COMMONLY KNOWN AS: 828 KERR STREET <br />TO BE AN ECONOMIC <br />+ REVITALIZATION AREA FOR PURPOSES OF A THREE (3) YEAR <br />REAL PROPERTY TAX ABATEMENT FOR <br />4,000 SQ FT OFFICE ADDITION TO 828 KERR ST. & BUILDING RENOVATION, ADVANCED MASONRY <br />NAME OF PROJECT CONSTRUCTION, INC. <br />----------------------------------------------------------------------------------- <br />----------------------------------------------------------------------------------- <br />WHEREAS, the Common council of the City of South BEnd, Indiana, has adopted a <br />Declaratory Resolution designating certain areas within the City as Economic <br />Revitalization Areas for the purpose of tax abatement consideration; and <br />WHEREAS, a Declaratory Resolution designated the area commonly known as <br />828 Kerr Street and which is more particularly described as follows: <br />A part of Parcel 5 and the West Half of the vacated alley <br />lying East of and adjacent to Parcel 5 between Garst Street <br />and Kerr Street in the Innerbelt Industrial Park, a Subdivision <br />in the Southeast and Southwest Quarters of Section 11 and the <br />Northeast Quarter of Section 14, all in Township 37 North, Range 2 <br />East of the Second Principal Meridian, City of South Bend, Indiana, <br />the plat of which is recorded in Plat Book 211, page 1, in the Office <br />of the Recorder of St. Joseph County, Indiana, described as follows: <br />Beginning at the intersection of the middle line of said vacated <br />alley with the Northerly line of Parcel 5 extended to the West; <br />thence South 06"11' East, 243.39 feet to the Southerly line of said <br />Parcel 5; thence North W47'37" West along the Southerly line of <br />said Parcel 5 a distance of 211 feet; thence North 06 °11' West, <br />243.32 feet to the Northerly line of said Parcel 5, thence <br />Easterly along the Northerly line of said Parcel 5 a distance of <br />212 feet to the place of beginning; together with the South Half <br />of that part of the vacated portion of Kerr Street which lies <br />adjacent to the North of the afore - described property as vacated <br />by Vacation Resolution 113385, 1973, under Record 114, page 404 of <br />the records of the Board of Public Works of the City of South <br />Bend; together with all rights of easements for right of way <br />purposes in common with other contiguous owners over that <br />portion of the East Half of the vacated alley between Garst Street <br />and Kerr Street. <br />with said real estate having the following Key No. 18- -8022- 089401 ,as <br />an Economic Revitalization Area; and <br />WHEREAS, notice of the adoption of a Declaratory Resolution and the public <br />hearing before the Council has been published pursuant to IndianaCode 6- 1.1 -12.1- <br />2.5; and <br />WHEREAS, the Council held a public hearing for the purposes of hearing all <br />remonstrances and objections from interested persons; and <br />WHEREAS, the Council has determined that the qualifications for an economic <br />revitalization area have been met. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South <br />Bend, Indiana, as follows: <br />SECTION I. The Common Council hereby confirms its Declaratory Resolution <br />designating the area described herein as an Economic Revitalization Area for the <br />purposes of tax abatement. Such designation is for Real property tax <br />abatement only and is limited to two (2) calendar years from the date of adoption of <br />the Declaratory Resolution by the Common council. <br />1 <br />
