City Clerk RESOLUTION NO. 3 (<) R � — 0 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROVING A PETITION OF THE SOUTH BEND BOARD OF ZONING APPEALS FOR THE PROPERTY LOCATED AT 736 COUNTRY CLUB LANE WHEREAS, Indiana Code Section 36 -7 -4- 918.6, requires the Common Council to give notice pursuant to Indiana Code Section 5- 14- 1.5 -5, of its intention to consider Petitions from the Board of Zoning Appeals for approval or disapproval; and WHEREAS, the Common Council must take action within sixty (60) days after the Board of Zoning Appeals makes its recommendation to the Council pursuant to I.C. 36- 7-4- 918.6; and WHEREAS, the Common Council is required to make a determination in writing on such requests pursuant to Indiana Code Section 36 -7 -4- 918.4, and WHEREAS, the South Bend Board of Zoning Appeals has made a recommendation, pursuant to applicable state law. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA as follows: SECTION I. The Common Council has provided notice of the hearing on the Petition from the Board of Zoning Appeals pursuant to Indiana Code Section 5- 14- 1.5 -5, requesting that a Special Exception be granted for the property located at: 736 Country Club Lane, South Bend, Indiana 46615. Lot 18 -5141 -5129, or Lot 11 Morris Country Club Add. in order to permit a Special Exception for an accessory dwelling. We would like to finish out the existing space over our stand alone garage as living space. This living space will primarily be used as a home office. We may also use it to house an occasional guest visiting us on a short term basis. This space will be heated and include a bathroom. This will not be used as a rental unit. It will be used for our own personal use only. SECTION II. Following a presentation by the Petitioner, and after proper public hearing, the Common Council hereby approves the petition of the South Bend Board of Zoning Appeals, a copy of which is on file in the Office of the City Clerk. SECTION III. The Common Council of the City of South Bend, Indiana, hereby finds that: The proposed use will not be injurious to the public health, safety, comfort, community moral standards, convenience or general welfare; 2. The proposed use will not injure or adversely affect the use of the adjacent area or property values therein; 3. The proposed use will be consistent with the character of the district in which it is located and the land uses authorized therein; 4. The proposed use is compatible with the recommendations of the City of South Bend Comprehensive plan; all of which is requested by the South Bend Municipal Code § 21 -09.03 (i). SECTION IV. Approval is subject to the Petitioner complying with the reasonable conditions established by the Board of Zoning Appeals which are on file in the office of the City Clerk. SECTION V. The Resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. It will be used for our own personal use only. In addressing the various standards you must consider when approving a variance, we offer the following information: a. Why the approval will not be injurious to the public health, safety, morals, and general welfare of the community: We are simply finishing out existing square footage over our stand -alone garage. There will be no change to the physical structure. The garage is located at the top of our driveway on a quiet residential street. The house is set back from the street approximately 100 feet, and the garage is set back another 50 from the front of the house. There should. be no effect on our neighbors or others in the community. b. Why the use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner. Again, we are making no changes to the existing physical structure of the garage. We are simply finishing off the interior space to include heat and a bathroom. c. Why the strict application of the terns of the zoning ordinance will result in practical difficulties in the use of the property. My husband owns his own business and thus, works many long nights and weekends. It is imperative that he has an office space which is quiet and not accessible to our children. We do not have an alternative space inside the main house. d. The proposed use is compatible with the recommendations of the City of South Bends Comprehensive Plan As stated above this project will in no way diminish the surrounding neighborhood. The Board of Zoning Appeals gave it a public hearing on December 22, 2006, at which time the following action was taken: Upon a motion by Mr. Sassano, being seconded by Mr. Hoban and unanimously carried, the petition for Special Exception for an accessory dwelling in a "SF1" district, on property located at 736 Country Club Drive, is sent to the Common Council with a Favorable Recommendation.
