REGULAR MEETING NOVEMBER 10, 2008 <br /> <br /> <br />th <br />Mr. Thomas L. Bodnar, Assistant City Attorney, 14 Floor County-City Building, 227 <br />W. Jefferson Blvd., South Bend, Indiana, made the presentation for this bill. <br /> <br />Mr. Bodnar advised that this bill is an amendment to the proposed Fee Ordinance. He <br />noted that the only change from the original bill submitted is in Items 6 and 7. A third <br />classification has been added to Item 6. The Police Department has two different <br />methods of reproducing photos. The cost to the department is substantially different and <br />is reflected in the fees proposed. The choice of method is determined by the request of <br />the customer. Mr. Bodnar noted that Item 7 clarifies the charge per finger print card. <br />Each additional original card will take the same amount of time by a police officer. <br /> <br />This being the time heretofore set for the Public Hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. <br /> <br />There being no one present wishing to speak to the Council either in favor of or in <br />opposition to this bill, Councilmember Puzzello made a motion for favorable <br />recommendation to full Council concerning this bill as substituted. Councilmember <br />Varner seconded the motion which carried by a voice vote of eight (8) ayes. <br /> <br /> <br />BILL NO. 69-08 PUBLIC HEARING ON A BILL OF THE <br /> COMMON COUNCIL OF THE CITY OF <br /> SOUTH BEND, INDIANA, AMENDING <br /> CHAPTER 5 OF THE SOUTH BEND <br /> MUNICIPAL CODE TO ADJUST FEES <br /> RELATED TO ANIMAL CARE AND <br /> CONTROL <br /> <br />Councilmember White made a motion to hear the substitute version of this bill. <br />Councilmember Varner seconded the motion which carried by a voice vote of eight (8) <br />ayes. <br /> <br />Councilmember LaFountain, Chairperson, Personnel & Finance Committee reported that <br />this committee held a public hearing on this bill this afternoon and voted to send it to the <br />full Council with a favorable recommendation. <br /> <br />th <br />Catherine Toppel, Director, Department of Code Enforcement, 13 Floor County-City <br />Building, 227 W. Jefferson Blvd., South Bend, Indiana, made the presentation for this <br />bill. <br /> <br />Ms. Toppel advised that this bill would allow the Department of Code Enforcement to <br />adjust the fees to cover the costs of providing Animal Care and Control Services. She <br />noted that this substitute bill changes pick of surrendered animal from $10.00 to $20.00; <br />microchip from $10.00 to $20.00; and surrender from $10.00 to $20.00. <br /> <br />This being the time heretofore set for the Public Hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. <br /> <br />There being no one present wishing to speak to the Council in favor of this bill. <br /> <br />The following individual spoke in opposition to this bill. <br /> <br />Melissa Machowiak, 56830 Elmer Avenue, South Bend, Indiana, advised that she had <br />adopted a Doberman pinscher dog from Animal Care and Control. She advised that <br />shortly after the dog got sick and was diagnosed with diabetes. She stated that when she <br />advised Animal Care and Control of the dog’s condition they did nothing to correct the <br />situation. She stated that she could have given back the dog, but her children had already <br />gotten attached and could not give the dog back. Ms. Machowiak stated that she believes <br />that Animal Care and Control was negligent by letting a dog with such a disease be <br />adopted out and that they should have known something was wrong with the dog. She <br />stated that she believes that Animal Care and Control should help pay for her veterinarian <br />bills. <br /> 6 <br /> <br />
