RESOLUTION NO. , 3x - /'s <br />A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY <br />RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF <br />SOUTH BEND, INDIANA, COMMONLY KNOWN AS <br />SOUTHWEST CORNER OF NIMTZ PARKWAY <br />AND COMMERCE DRIVE <br />TO BE AN ECONOMIC REVITALIZATION AREA FOR PURPOSES <br />OF A TEN (10) YEAR REAL PROPERTY TAX ABATEMENT FOR <br />BLACKTHORN NIMTZ PARTNERS L.P. <br />WHEREAS, the Common Council of the City of South'Bend, Indiana, has adopted a <br />Declaratory Resolution designating certain areas within the City as Economic Revitalization <br />Areas for the purpose of tax abatement consideration; and <br />WHEREAS, a Declaratory Resolution designated the area commonly known as <br />Southwest corner of Nimtz Parkway and Commerce Drive and which is more particularly <br />described as follows: <br />Lots 16 and 17 of the H.G. Bans Centre Industrial Park which are a part of: <br />The Southwest Quarter (1/4) of Section 21, Township 38 North, Range 2 East, excepting <br />therefrom the following two tracts: <br />Tract 1: Commencing at the Northwest corner of the Southwest 1/4 of Section 21, Township <br />38 North, Range 2 East, thence in an Easterly direction along the North line of said Quarter <br />Section a distance of 650.41 feet to the point of beginning, thence continuing along the said <br />North line in an Easterly direction, on the arc of a circular curve to the right of 0° 58'28.1 <br />a distance of 983.65 feet to the East line of said Quarter Section; thence in a Southerly <br />direction along said East line a distance of 350.36 feet; thence in a Northwesterly direction <br />on the arc of a circular curve to the left of 010 01'36.8" a distance of 2148.26 feet to the <br />point of beginning. <br />Tract 2: A part of the Southwest 1/4 of Section 21, Township 38 North, Range 2 East, St. <br />Joseph County, Indiana, described as follows: Beginning at the Northeast corner of said <br />Quarter Section; thence South 00° 52'00" East 424.89 feet along the East line of said <br />Quarter Section to the Northern Boundary of the Indiana East -West Toll Road; thence along <br />said Northern boundary northwesterly 989.03 feet along an arc to the left having a radius of <br />5,879.58 feet and subtended by a long chord having a bearing of North 65° 33144" West and <br />a length of 987.87 feet to the North line of said Quarter Section; thence North 88° 57'48" <br />East 893.08 feet along said North line to the point of beginning. <br />(Subject to final Area Plan Commission approval of final subdivision) <br />and which has Key Number 25- 1010 -0361, as an Economic Revitalization Area; and <br />WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing <br />before the Council has been published pursuant to Indiana Code 6- 1.1- 12.1 -2.5; and <br />WHEREAS, the Council held a public hearing for the purposes of hearing all <br />remonstrances and objections from interested persons; and <br />WHEREAS, the Council has determined that the qualifications for an economic <br />revitalization area have been met. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of <br />South Bend, Indiana, as follows: <br />
