<br />RESOLUTION OF THE SOUTH BEND COMMON COUNCIL
<br />DETERMINING, AFTER INVESTIGATION, THAT THE LEASE OF
<br />OFFICE SPACE FOR THE OFFICES OF THE CONSOLIDATED
<br />COUNTY /CITY BUILDING DEPARTMENT IS NEEDED
<br />WHEREAS, the Board of Public Works of the City of South Bend,
<br />Indiana ( "Board "), on November 20, 1995, received a Petition signed by
<br />fifty (50) owners of real property of the City of South Bend,
<br />requesting that the Board provide additional office space for the
<br />offices of the Consolidated County /City Building Department by
<br />entering into a Lease Agreement with the lst Source Bank of South
<br />Bend, Indiana, for approximately 3498 square feet and being situated
<br />on the lst Floor of the building known as the First Bank Building, 205
<br />West Jefferson Boulevard, South Bend, Indiana, for a term of one (1
<br />year, with a monthly rental of Two Thousand Five Hundred Thirty -five
<br />and 50/100 Dollars with an option to renew for an additional two (2)
<br />years at this same monthly rental; and
<br />WHEREAS, the Board also received, on November 20, 1995, a
<br />certificate of the St. Joseph County Auditor certifying that the
<br />verifier of the Petition and the signatories of the petition are
<br />taxpayers of property located within the corporate limits of the City
<br />of South Bend; and
<br />WHEREAS, pursuant to IC 36- 1 -10 -7 (2) requires, prior to the Board
<br />of Public Works entering into such a lease agreement, that the Common
<br />Council, after investigation, determine that the same is needed.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND COMMON COUNCIL,
<br />AS FOLLOWS:
<br />1. That the Common Council has conducted a public hearing on this
<br />resolution, and has heard persons desiring to speak in favor and
<br />opposed to the adoption of this resolution.
<br />2. That the Common Council finds that neither the City of South
<br />Bend nor St. Joseph County has adequate space available in the County -
<br />City Building located at 227 West Jefferson Boulevard, South Bend,
<br />Indiana, large enough to house the entire staff of the Consolidated
<br />County /City Building Department ( "Department ") and which are otherwise
<br />adequate to serve the needs of the Department.
<br />3. That the most efficient and cost effective allocation of
<br />resources warrants the continued lease of office space outside the
<br />County -City Building.
<br />4. That approximately 3498 square feet of office space is
<br />available on the lst Floor of the building known as the First Bank
<br />Building, 205 West Jefferson Boulevard, South Bend, Indiana, and is
<br />leased to the City of South Bend for the use of the Department through
<br />November 30, 1995, and is available for lease.
<br />5. That on November 20, 1995, a petition signed by fifty (50)
<br />taxpayers of the City of South Bend, Indiana, was filed with the Board
<br />of Public Works of the City of South Bend, Indiana requesting that it
<br />provide office space for the offices of the Consolidated County /City
<br />Building Department by entering into a lease agreement with the lst
<br />Source Bank of South Bend, Indiana, for approximately 3498 square feet
<br />and being situated on the lst Floor of the building known as the First
<br />Bank Building, 205 West Jefferson Boulevard, South Bend, Indiana, for
<br />a monthly rental of Two Thousand Five Hundred Thirty -five and 50 /100
<br />Dollars ($2,535.50).
<br />6. That on November 20, 1995, the Board of Public Works received
<br />a certificate signed by the St. Joseph County Auditor, certifying that
<br />the verifier and the signatories of the petition are taxpayers of
<br />property located within the corporate limits of the City of South
<br />Bend.
