RESOLUTION NO. 20 b— q5 <br />A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY <br />RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF <br />SOUTH BEND, INDIANA, COMMONLY KNOWN AS <br />THE NORTHEAST CORNER OF MAIN STREET <br />AND BROADWAY STREET <br />TO BE AN ECONOMIC REVITALIZATION <br />AREA FOR PURPOSES OF A TEN (10) YEAR REAL <br />PROPERTY TAX ABATEMENT FOR <br />RICHARD ALLEN <br />WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a <br />Declaratory Resolution designating certain areas within the City as Economic Revitalization <br />Areas for the purpose of tax abatement consideration; and <br />WHEREAS, a Declaratory Resolution designated the area commonly known as the <br />northeast corner of Main Street and Broadway Street and which is more particularly described <br />as follows: <br />That part of the Northwest Quarter of Section 13, Township 37, North, Range 2 <br />East, Portage Township, which is described as: Lots 17, 18, 19 and 20 of the <br />recorded Plat of "Stull's Third Addition to the City of South Bend" as shown in <br />Plat Book #6, on Page #109 in the records of the St. Joseph County, Indiana <br />Recorder's Office and being more particularly described as: <br />Beginning at the Southwest Corner of Lot 20 of the recorded Plat of "Stull's <br />Third Addition to the City of South Bend" as shown in Plat Book #6, on Page <br />#109 in the records of the St. Joseph County, Indiana Recorder's Office said <br />point also being the intersection of the East right -of -way line of Main Street and <br />the North right -of -way line of Broadway Street; thence N. 00 °19'52" W. along <br />said East line, 264.24 ft. (Record, 264.0 ft.) to the Northwest corner of Lot 17 <br />in said Subdivision; thence N. 89 °30'02" E. along the North line of said Lot, <br />165.70 ft. (Record, 165.75 ft.) to the West right -of -way line of a 14 ft. public <br />alley and the Northeast corner of said Lot 17; thence S. 00'17'54" E. along <br />said West line, 264.50 ft. (Record, 264.0 ft.) to the North right -of -way line of <br />Broadway Street, and the Southeast corner of said Lot 20; thence S. 89 °35'32" <br />W. along the South line of said Lot and North right -of -way line, 165.55 ft. <br />(Record, 165.75 ft.) to the Point of Beginning <br />with said real estate having the following Key No.: 18 -8004 -0209 through 18- 8004 -0215, as <br />an Economic Revitalization Area; and <br />WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing <br />before the Council has been published pursuant to Indiana Code 6 -1.1- 12.1 -2.5; and <br />WHEREAS, the Council held a public hearing for the purposes of hearing all <br />remonstrances and objections from interested persons; and <br />WHEREAS, the Council has determined that the qualifications for an economic <br />revitalization area have been met; and <br />WHEREAS, the Council issued a Confirmatory Resolution conforming the adoption of <br />the Declaratory Resolution as Resolution No. 2130 -94 on May 23, 1994; and <br />
