RESOLUTION NO. �3 U- � 6 <br />A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY <br />RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF <br />SOUTH BEND, INDIANA, COMMONLY KNOWN AS <br />208 EAST SAMPLE STREET <br />TO BE AN ECONOMIC REVITALIZATION AREA FOR PURPOSES <br />OF A THREE (3) YEAR REAL PROPERTY TAX ABATEMENT FOR <br />THE SOUTH BEND REDEVELOPMENT COMMISSION <br />FOR THE BENEFIT OF: <br />CHARLES AND HATTIE P. PRYOR <br />WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a <br />Declaratory Resolution designating certain areas within the City as Economic Revitalization <br />Areas for the purpose of tax abatement consideration; and ' <br />WHEREAS, a Declaratory Resolution designated the area commonly known as 208 <br />East Sample Street and which is more particularly described as follows: <br />THAT PART OF THE NORTHWEST QUARTER OF SECTION 13, <br />TOWNSHIP 37 NORTH, RANGE 2 EAST, CITY OF SOUTH BEND, ST. <br />JOSEPH COUNTY, INDIANA WHICH IS DESCRIBED AS: BEGINNING <br />AT THE INTERSECTION OF THE SOUTH LINE OF SAMPLE STREET <br />WITH THE EAST LINE OF THE RECORDED PLAT OF "BAKER'S FIRST <br />ADDITION ", AS RECORDED IN THE OFFICE OF THE RECORDER OF <br />ST. JOSEPH COUNTY, INDIANA; THENCE ALONG THE SOUTH LINE <br />OF SAMPLE STREET, S. 89 °- 44' -10" E., 194.37 FT. (EAST, 194.00 FT., <br />RECORD); THENCE S. 00 °- 44' -42" W., 146.68 FT. TO A POINT ON THE <br />NORTH LINE OF LOT 4 OF SAID RECORDED PLAT; THENCE N. 89'- <br />34'-53" W. ALONG SAID NORTH LINE, 6.91 FT.; THENCE S. 00'- 32' -18" <br />W., 96.41 FT. THE NORTH RIGHT -OF -WAY LINE OF OHIO STREET; <br />THENCE ALONG SAID NORTH LINE, N. 89'- 39' -20" W., 177.44 FT. TO <br />A POINT WHICH IS S. 89'- 39' -20" E., 38.50 FT. FROM THE <br />SOUTHWEST CORNER OF LOT 1 IN SAID SUBDIVISION; THENCE N. <br />00'- 27' -47" E., 96.64 FT. TO THE NORTH LINE OF SAID LOT 1; <br />THENCE ALONG SAID NORTH LINE, N. 89'- 34' -53" W., 9.46 FT.; <br />THENCE N. 000- 34' -34" E., 146.15 FT. (NORTH, 145.0 FT., RECORD) TO <br />THE POINT OF BEGINNING. <br />and which has Key Number 18- 7001 -0008, as an Economic Revitalization Area; and <br />WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing <br />before the Council has been published pursuant to Indiana Code 6 -1.1- 12.1 -2.5; and <br />WHEREAS, the Council held a public hearing for the purposes of hearing all <br />remonstrances and objections from interested persons; and <br />WHEREAS, the Council has determined that the qualifications for an economic <br />revitalization area have been met. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of <br />South Bend, Indiana, as follows: <br />SECTION I. The Common Council hereby confirms its Declaratory Resolution designating <br />the area described herein as an Economic Revitalization Area for the purposes of tax <br />abatement. Such designation is for Real property tax abatement only and is limited to two <br />(2) calendar years from the date of adoption of the Declaratory Resolution by the Common <br />Council. <br />
