A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA ADOPTING A WRITTEN FISCAL PLAN AND
ESTABLISHING A POLICY FOR THE PROVISION OF SERVICES TO AN
ANNEXATION AREA IN CENTRE TOWNSHIP
(DRAKE ANNEXATION AREA)
WHEREAS, there has been submitted to the Common Council of the City of South Bend,
Indiana, an Ordinance and a petition by all (100%) property owners which proposes the
annexation of real estate located in Centre Township; St. Joseph County, Indiana, which is more
particularly described in Section I of this Resolution; and
WHEREAS, the territory proposed to be annexed encompasses approximately 3.31 acres
of land containing a grouping of three single story motel buildings, which property is at least
12.5% contiguous to the current City limits, i.e., approximately 18.3 % contiguous, generally"
located at the northwest corner of U.S. 31 and Kern Road. It is anticipated that the annexation
area will be developed for athree-story motel facility. This development will require a basic
level of municipal public services of anon-capital improvement nature, including police and fire
protection, street and road maintenance, street sweeping, flushing, snow removal, and sewage
collection, as well as services of a capital improvement nature, including street and road
construction, street lighting, a sanitary sewer system, a water distribution system, and a storm
water system and drainage plan; and
WHEREAS, the South Bend Common Council now desires to establish and adopt a fiscal
plan and establish a definite policy showing: (1) the cost estimates of services of anon-capital
nature, including police and fire protection, street and road maintenance, street sweeping,
flushing, and snow removal, and sewage collection, and other non-capital services normall}~
provided within the corporate boundaries; and services of a capital improvement nature including
street and road construction, street lighting, a sanitar}~ sewer extension, a water distribution
system, and a storm water system to be furnished to the territory to be annexed (2) the method(s)
of financing those services; (3) the plan for the organization and extension of those services: (4)
that services of anon-capital nature will be provided to the annexed area within one (1) year
after the effective date of the annexation, and that they will be provided in a manner equivalent
in standard and scope to similar non-capital services provided to areas within the corporate
boundaries of the City of South Bend, regardless of similar topography, patterns of land use, and
population density; (5) that services of a capital improvement nature will be provided to the
annexed area within three (3) years after the effective date of the annexation within the same
manner as those services are provided to areas within the corporate boundaries of the City of
South Bend regardless of similar topography, patterns of land use, or population density, and in a
manner consistent with federal, state and local laws, procedures, and planning criteria; and (6)
the plan for hiring the employees or other governmental entities whose jobs will be eliminated by
the proposed annexation; and
WHEREAS, the City of South Bend Board of Public Safety and Board of Public Works

have each approved the written fiscal plan and policy and established a policy for the provision
of services to the territory proposed to be annexed, which plan and policy the Common Council
finds to be appropriate and in the best interest of the City, and which it desires to adopt.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA, AS FOLLOWS:
Section I. It is in the best interest of the City of South Bend and the area proposed to be
annexed that the following described real property located in Centre Township, St. Joseph
County, Indiana, be annexed to the City of South Bend:
A parcel of land being a part of the Southeast Quarter (1/4) of Section Thirty-Five
(35), and a part of the Southwest Quarter (1/4) of Section Thirty-Six (36), all in
Township Thirty-Seven (37) North, Range Two (2) East, Centre Township, St.
Joseph County, Indiana and being more particularly described as follows:
Beginning at a point on the east line of said Southeast Quarter, a distance of
406.4 feet North 0 degrees 00 minutes 00 seconds East of the Southeast corner
of said Southeast Quarter; thence South 13 degrees 35 minutes 03 seconds East,
along the westerly right-of--way of Main Street, a distance of 153.90 feet to its
intersection with the westerly right-of--way line of U.S. Highway #31; thence
South 17 degrees 09 minutes 11 seconds West, along said U.S. #31 right of- way
line, a distance of 133.80 feet to an iron stake found in place; thence North 89
degrees 19 minutes 49 seconds West, parallel with the south line of said Southeast
Quarter, a distance of 501.70 feet to an iron stake found in place and being on a
point of the east line of a tract of land conveyed to Raymond K. Snyder and Anna
J. Snyder in Deed Record 315, page 175; thence North 0 degrees 27 minutes 06
seconds West, a distance of 274.67 feet to an iron stake found in place; thence
South 89 decrees 39 minutes OS seconds East, a distance of X07.23 feet to the
place of becinninc. Commonly known as 60971 U.S. 31 South, South Bend,
Indiana
Section II. It shall be and hereby is now declared and established that it is the policy of
the City of South Bend, to furnish to said territory services of anon-capital nature, such as police
and fire protection, street and road maintenance, street sweeping, flushing, and snow removal,
within one (1) year of the effective date of the annexation in a manner equivalent in standard and
scope to services furnished by the City to other areas of the City regardless of similar
topography, patterns of land utilization, and population density; and to furnish to said territory,
services of a capital improvement nature such as street and road construction, a street light
system, a sanitary sewer system, a water distribution system, a storm water system and drainage
plan, within three (3) }ears of the effective date of the annexation in the same manner as those
services are provided to areas within the corporate boundaries of the City of South Bend
regardless of similar topography, patterns of land use, or population density.
Section III. The South Bend Common Council shall and does hereby now establish and
adopt the Fiscal Plan, attached hereto as Exhibit "A", and made a part hereof, for the furnishing
of said services to the territory to be annexed, which provides, among other thins, that the
public sanitary sewer and water network is available with capacity sufficient to service this area
with any extensions or improvements for future development to be paid by the developer; that
street lighting and parking will be installed at the developer's expense; and that a street drainage
plan will be also be planned, provided and paid for by the developer subject to compliance with
state and local law.
Section IV. In consideration of pedestrian safety and proper vehicular movement, it is
required as a condition of rezoning and annexation that the developers give very careful
consideration to vehicular access and circulation as well as pedestrian movement for the
developments within the annexation area. In this regard the annexation and rezoning is subject to
the following condition:
A traffic impact analysis of the proposed development and site plan to guide the
determination of roadway modifications and intersection controls necessary and
sufficient to provide safe and orderly traffic movements.
It should also be required that neo-traditional building/site design elements be included in terms
of context, setback, orientation, spacing, style, massing, height, entry, fenestration, materials,
accessory buildings, landscape buffering and lighting that achieve development and design of the
highest possible quality per the South Bend zoning ordinance standards. It is required that the
annexation area integrate harmoniously with the surrounding residential areas to the west until
such time as the new U.S. 31 alignment is constructed. All screening, signage vehicular access
shall conform to the latest City of South Bend standards and ordinances.
Building plans and other information to satisfy all requirements imposed by this Resolution must
be submitted by the developer to the City as part of the development review process. Failure to
comply with all the conditions may result in the City's repeal of annexation.
Section V. This Resolution shall be effective from and of the date of adoption by the
Common Council and approval by the Mayor.

SECTION I. INTRODUCTION
A. General
This Fiscal Plan represents the City of South Bend's (hereinafter, "City") policy for the annexation
of property in Centre Township, St. Joseph County, Indiana (hereinafter, "Annexation Area"), and
was developed through the cooperative efforts of the Area Plan Commission and the following
City Departments:

SECTION II. GENERAL DATA
A. Location
The Annexation Area is generally located at the northwest comer of U.S. 31 South and Kern Road.

B. Legal Description
The Annexation Area is part of the Southeast Quarter of Section 35, and a part of the southwest
quarter of Section 36, Township 37 North, Range 2 East, Centre Township, St. Joseph County,
Indiana. For a complete legal description see Page 1 S.
C. Contiguity
The Annexation Area is at least 1/8 (12.5%) contiguous to the current City limits:

D. Size of Annexation Area
The Annexation Area is 3.31 acres in area.
E. Buildings and Land Use
The site contains a grouping of three single-story motel room buildings. The land is slated to be
used for athree-story motel facility.
F. Zoning & Subdivisions
The site is zoned "C" Commercial in unincorporated St. Joseph County. It is proposed to be zoned
"CB" Community Business upon approval of the City Council and incorporation into the City of
South Bend.

H. Tax Rate
The tax rates used are those of 2005 payable in 2006.
The Township Rate will decrease by 50.1155 per 5100.00 of assessed valuation with the deletion
of the Fire Fighting Fund and the Cumulative Fire assessments.
The tax rate for the Annexation Area will increase by 52.2971 with the addition of the City and
Town Rate, the Redevelopment District Rate and the South Bend Transpo Rate.
The net increase in property taxes will be S2.1816 per 5100.00 of assessed valuation. Table 2
shows representative tax rate information as published by the St. Joseph County Auditor.

The Annexation Area will be in the 6th District.
l{. Hiring Plan
It is anticipated that this annexation will not result in the elimination of jobs for employees of any
other governmental entities. The Centre Township Trustee has been notified of this Annexation.
SECTION III. MUNICIPAL SERVICES
A. Public Works
Sewer - A 30" diameter public sewer is available on the Main Street frontage of the
Annexation area. It has sufficient capacity to carry load expected from. this area. Pzrblic sewer
extensions, at developer expense, tivill be necessary to serve airy new lots created by fi~ttrre strbrlivision
of this annexation area, if any. The wastewater treatment plant and the downstream collection
facilities are adequately sized to handle the additional flow. No capital expenditure would be needed
for those facilities as a result of this annexation. Revenues from the development of the site will be
sufficient to provide sewage collection and treatment services to the site.
Water -The South Bend Water Works currently has a 12" water main on the west side of U.S. 31
South that extends south of Kern Road. There are also 6" mains on Willis and on Burdette that
loop through Irish Crossings. Recent flow teat data does not exist but static pressure is 70 psi and
there is adequate capacity in the annexation area. .
Extensions of, or taps into sanitary sewer and water lines shall be governed by LC. 36-9-22-2,
I.C. 8-1.5-3 and 4, and the rules and regulations of the South Bend Water Works and Sewer Utility.
Street Lighting -The developer of this property will be required to install a street lighting system.
Additional revenue to the General Fund from this annexation area will be sufficient to pay for
street light operations.
Waivers of Annexation - No waivers of annexation are in effect for the Annexation Area.
Streets -Boundary streets in this annexation area are already within the City limits and are
being maintained by the City. No capital expenditure will be needed to extend sweeping and snow
removal service to the area. Gas tax reimbursements to the Motor Vehicle Highway Fund pay for
operation of the service.
Drake Annexation Area
Main Street and its intersection with Michigan Street, within the annexation area, do not meet
current geometric standards for roadways that serve more traffic than currently exists. The multi-story
motel proposed for this site will generate more vehicle trips on Main Street and through the Main/LJ.S.
31 intersection than currently use those facilities. Thtts, the potential developer will steed to make a
traffic impact analysis of the proposed development at:d site plan to guide a determination of roadway
modifications and intersection controls necessary and sufficient to provide safe and orderly traffic
movements. The Indiana Department of Transportation has undertaken a project to relocate US31
between Plymouth and South Bend. That project will impact this property with a proposed taking or
real estate on the west and Main Street realignment on the east.
Drainage Plan -Drainage facilities will be required to be constructed by the developer and meet
the latest City of South Bend standards.

B. Police Department
The Annexation Area would be expected to be added to the already existing BEAT 15. Police patrols,
traffic enforcement, and emergency responses will be part of the services the City will offer to this
area. This proposed annexation would require officers to cover a relatively small additional area to
this beat. However, due to the nature of the type of use proposed, calls for service can increase at aiiv
time for various reasons. At this time it is not expected that this annexation would cause calls for
service to increase significantly and it is not anticipated that it will be necessary to increase police
patrols beyond the already existing beat patrol at this time. The area under consideration is not
expected to cause any unusual problems.
At the present time the cost for servicing the proposed area is not expected to impact the existing
budget of the Police Department with any significance. However, this area, as well as all other
areas of the City, will continually be monitored for level of service demands and other criteria that
would necessitate additional resources through budgetary increases or possibly shifting of existing
resources, such as a beat restructure.
Police services and response time in this area can be expected to be comparable and consistent
with that as in all other areas of the City. Police coverage to this area could begin immediately
upon annexation and coordination of the conversion of the 911 emergency phone system for that
area.

C. Fire Department
Fire Response -The City provides a fully staffed, full time fire department housed in 12 fire
stations strategically located throughout the city. The Annexation Area will be serviced primarily
by Station #10, located at 5301 York Road, approximately 2.4 miles away. Additional Fire
Department units would respond from Fire Station #8 located at 2401 Twyckenham Drive which is
approximately 3.7 miles away.
The South Bend Fire Department does not foresee any unusual fire protection problems related to
this annexation. Response times will be comparable to other areas of the City. No additional
equipment will need to be purchased or personnel hired to service the Annexation Area. Adequate
water supply will be necessary as development takes place. The Fire Department will continue tq
review and monitor response times in this area and make necessary recommendations to improve
response times that are comparable to other areas of the City.
Emergency Medical Response -The City, under contract with St. Joseph County, provides
emergency medical response to the unincorporated areas of St. Joseph County. Of the seven
ambulances currently in service, 3 are dedicated for response to the unincorporated areas. These
are Medic Units #10, 1 1, and 12. The Annexation Area is currently being serviced by Medic #10,
located at Fire Station #10 at 5303 York Road. Upon incorporation, the Annexation Area will be
serviced by Medic #1, also located at Fire Station #10.
Emergency medical response will continue to be provided by the City of South Bend. Response
times will be comparable to other areas of the City. No additional equipment will need to be
purchased or personnel hired to service the Annexation Area.

D. Code Enforcement
The Annexation Area will be added to Area 6.

The Department of Code Enforcement will be able to provide services to the Annexation Area with
comparable response times. The Department will respond to calls for service upon the effective
date of the Annexation. Full and dedicated response will be in place within one year of the
effective date of the Annexation.

E. Environmental Services
Wastetivater Treatment - Wastewater treatment services are supported by user fees, and are paid
through the Water Works billing system.
Solid lYaste -Industrial, commercial and apartment customers are not served by the Bureau of
Solid Waste. The annexation will contain a motel. This use will have centralized waste collection
locations. A licensed private waste hauler will be required to serve this developments.

For reference purposes, the following Bureau of Solid Waste rates apply for residential customers:
Single family rate: $8.80 per month.
Senior rate: $5.50 per month.
Duplex rate: $13.80 per month
Tri-plex: $18.80 per month
Quad: $23.80 per month
Recycling fee: $1.97 per month
F. Administrative Services
The City of South Bend provides a wide range of services other than those noted above, such as the
Mayor's office, the Legal Department, and the Parks & Recreation.
These services are available upon the effective date of the Annexation. Full and dedicated
response for non-capital services will be in place within one year of the effective date of the
Annexation. Costs for these services have not been calculated.
The incorporation of the Annexation Area will not effect the provision of other services currently
provided to this property on acounty-wide basis. The St. Joseph County Health Department, the
St. Joseph County Public Library, the Area Plan Commission and the St. Joseph County/South
Bend Building Department are some of the county-wide agencies and their services that will
continue to provide the same type and level of services to the Annexation Area.
County-wide services will continue to be supported by the County and Township tax rates that will
remain in effect.
SECTION IV. LAND USE ANALYSIS & DEVELOPMENT CRITERIA
As with any new development, the proposed use and development of this site becomes important
relative to its relationship with the existing, surrounding uses. Ciry Plan, South Bend's
comprehensive plan, notes that land use relationships, pedestrian movement/safety and vehicular
site access are important elements to be addressed in developments of all kinds. City Pla~i also
expresses a need to consider how buildings relate to the street. Building design that is sensitive to
massing, shape, scale and finishes will ensure that private development will enhance and reinforce
the City's commitment to development and design of the highest quality.
Land Use-Transportatiot: A~talysis
The Annexation Area is an approximately 3.31 acres in size. Land directly north and south is zoned
"C" Commercial in unincorporated St. Joseph County. The property to the east across U.S. 31 is
zoned "CB" Community Business in the City of South Bend. The annexation area is located along
a commercial comdor that contains a variety of uses.

Kern Road to the south of the annexation area serves as the vehicular access for new residential
growth occurring nearby. As part of the IDOT project to relocate US 31 between Plymouth and
South Bend, Kern Road is designated to serve as a diamond interchange point that will provide
access to old U.S. 31. Grade separation is also planned at Main Street and existing U.S. 31 to
facilitate proper vehicular safety. The planned INDOT improvements will require the acquisition of
a portion of west end of annexation area. The eastern frontage of the annexation area will also be
affected by the proposed roadway improvements.
Intersection roadway improvements as well as modifications to the City's water and sewer network
will be required to accommodate the development and the increase in traffic generated by the
development. It is anticipated that the Main Street and U.S. 31 intersection will require safety
improvements through widening and traffic calming enhancements.
The plans that have been unveiled propose a 3-story, 71 unit motel. The motel building is located
on the north part of the site and is oriented to the south. It is surrounded by seventy-three parking
spaces. The Ciry Plan Land Use Map illustrates that the area between Main Street, Southside
Church, existing U.S. 31 and the new U.S. 31 alignment should support commercial uses. It is
anticipated that with the planned improvement to U.S. 31 additional development will occur in this
area over the next 10-20 years.
Given the surrounding zoning and development patterns, the proposed "CB" zoning classification
request is appropriate for the annexation area. However, more detailed land use planning is needed
for areas to the south north of Kern Road to ensure that future development occurs in an
coordinated fashion.
Development Criteria

SECTION V. FISCAL IMPACT
1) Essential city services can be made available to the residents (and territory) of the Annexation
Area in a timely and comparable fashion per the requirements of State law and this fiscal plan.
2) The City is financially able to support city services to the territory sought to be annexed.
3) Required improvements made by the petitioner and/or owner of the parcels must be made in
accordance with the standards of the City of South Bend.
4) Required improvements made by the City will be completed within the time frames provide by
State law and this fiscal plan.
5) All figures are estimates. Final cost of capital expenditures, if any, will not be determined until
bids are publicly solicited, contracts are awarded and projects are closed out.

of the Southwest Quarter (1/4) of Section Thirty-Six (36), all in Township Thirty-Seven (37)
North, Range Two (2) East, Centre Township, St. Joseph County, Indiana and being more
particularly described as follows: Beginning at a point on the east line of said Southeast Quarter, a
distance of 406.54 feet North 0 degrees 00 minutes 00 seconds East of the Southeast corner of said
Southeast Quarter; thence South 13 degrees 35 minutes 03 seconds East, along the westerly right-
