Mayor RESOLUTION NO. 38 R A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND ADOPTING A WRITTEN FISCAL PLAN AND ESTABLISHING A POLICY FOR THE PROVISION OF SERVICES TO AN ANNEXED AREA IN PORTAGE TOWNSHIP (YOUNG ANNEXATION) WHEREAS, there has been submitted to the Common Council of the City of South Bend, Indiana, an ordinance which proposes the annexation of the hereinafter described real estate located in Portage Township, St. Joseph County, Indiana; and WHEREAS, the territory proposed to be annexed encompasses approximately 50.7 acres comprised primarily of undeveloped land, located in Portage Township, St. Joseph County, contiguous to the City of South Bend, approximately 76% of its aggregate external boundaries coinciding with the boundaries of the City of South Bend, is generally located at the Northeast corner of New Energy Drive and State Road 23, and is needed and can be used by the City of South Bend for its development in the reasonably near future. The development of the territory proposed to be annexed will require a basic level of municipal public services, which services shall include services of a non - capital nature, including street and road maintenance, fire and police protection, and services of a capital improvement nature, including street construction, street lighting, sewer facilities, water facilities and storm water facilities; and WHEREAS, the Common Council of the City of South Bend, Indiana now desires to establish and adopt a fiscal plan and establish a definite policy showing (1) the cost estimates of services of a non - capital nature, including street and road maintenance, police and fire protection and other non - capital services normally provided within the corporate boundaries, and services of a capital improvement nature, including street construction, street lighting, water facilites, sewer facilities, and storm water drainage facilities to be furnished to the territory to be annexed; (2) the method(s) of financing those services; (3) the plan for the organization and extension of those services; (4) that services of a non - capital nature will be provided to the annexed area within one (1) year after the effective date of the annexation, and that they will be provided in a manner equivalent in standard and scope to similar non - capital services provided to areas within the corporate boundaries of the City of South Bend, that have characteristic of topography, patterns of land use, and population density similar to that of the territory to be annexed; (5) that services of a capital improvement nature will be provided to the annexed area within three (3) years after the effective date of the annexation in the same manner as those services are provided to areas within the corporate boundaries of the City of South Bend that have characteristics of topography, patterns of land use and population density similar to that of the territory to be annexed and in a manner consistent with federal, state and local laws, procedures, and planning criteria; and (6) the plan for hiring the employees of other governmental entities whose jobs will be eliminated by the proposed annexation; and WHEREAS, the Board of Public Works of the City of South Bend and the Board of Public Safety of the City of South Bend have approved a written fiscal plan and established a policy for the provision of services to the territory to be annexed, which plan and policy the Common Council finds appropriate and the adoption of which as the plan and policy for the City of South Bend the Common Council finds to be in the best interests of the City. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I. That it is in the best interest of the City of South Bend and of the area proposed to be annexed that the real property located in Portage Township, St. Joseph County, Indiana, described at Exhibit "A," attached hereto and made a part hereof, be annexed to the City of South Bend. Section II. That it shall be and hereby is now declared and established that it is the policy of the City of South Bend to furnish to said territory services of a non - capital nature, such as street and road maintenance, police and fire protection, within one (1) year of the effective date of the annexation, in a manner equivalent in standard and scope to the services furnished by the City to other areas of the City which have characteristics of typography, patterns of land utilization and population density similar to said territory; and to furnish to said territory services of a capital improvement nature, such as street construction, street lighting, water facilities, sewer facilities, and storm water facilities, within three (3) years of the effective date of the annexation, in the same manner as those services are provided to areas within the corporate boundaries of the City of South Bend that have characteristics of topography, patterns of land use and population density similar to that of the territory to be annexed and in a manner consistent with federal, state and local laws, procedures, and planning criteria. Section III. That the Common Council for the City of South Bend shall and does hereby now establish and adopt the fiscal plan described in Exhibit "B ", attached hereto and made a part hereof, for the furnishing of said services to the territory to be annexed. Section IV. This Resolution shall be in full force and effect from and after its passage by the Common Council and approval of the Mayor. Adopted this lad —day of� 1997. General This Fiscal Plan represents the City of South Bend's (hereinafter, "City ") policy for the annexation of property in Portage Township, St. Joseph County (hereinafter, "Annexation Area "), and was developed through the cooperative efforts of the Area Plan Commission and the following City Departments: Legal Department Department of Public Works South Bend Fire Department South Bend Police Department Department of Code Enforcement Department of Community and Economic Development Department of Administration and Finance B. Need For Annexation of New Area In 1981, the City of South Bend established the Rum Village Industrial Park Tax Incremental Finance (TIF) district to encourage industrial development. The New Energy ethanol plant, the Airco carbon dioxide plant and the expansion of two existing facilities were some of the immediate successes of the TIF. The TIF area encompassed approximately 412 acres of industrial zoned land on the far west side of the City. The_ attractiveness of this area consisted of flat, open topography suitable for large industrial buildings, access to rail lines, and access to the St. Joseph Valley Freeway (then known as the US 31 Bypass), which connected to Elkhart County, the State of Michigan, and the Indiana Toll Road. In particular to the ethanol plant, the proximity to the south- western agricultural areas of St. Joseph County provided an easy means for farmers to truck in their crops. In 1993, this TIF was merged with the 220 acre Studebaker Corridor Development Area TIF to create the 2,400 acre Sample Ewing Development Area (SEDA). The joining of these two areas reinforced the City's planning efforts to attract industry and to have the financial means to help finance infrastructure development. Part of the original infrastructure development consisted of the construction of New Energy Drive and the necessary sewer and water extensions to support the ethanol plant. The Annexation Area borders the SEDA on the north and east sides. New Energy Drive, located on the western boundary of the Annexation Area, was one of the previously mentioned improvements connected with the original TIF district. The potential development of the Annexation Area is well within the scope of activity that was anticipated, and encouraged, for this part of the County. For these reasons, it is desirable that the Annexation Area have the same development standards as its neighboring properties in the City. Development of properties Annexation Area adjacent the Annexation Area and within the City, are subject to the ordinances and standards of the City; development of the Annexation Area is subject to the ordinances and standards of St. Joseph County. The ordinances and development standards of the City and of St. Joseph County are not identical, nor are they necessarily compatible. Since the Annexation Area is contiguous to the City yet subject to different development standards, zoning and other ordinances, planning for the development of the City in this vicinity is inherently more difficult and potentially frustrated. The Annexation Area, therefor, is needed and can be used by the City for development, and is a natural and logical extension of the City boundary. SECTION II. GENERAL DATA A. Location The Annexation Area is generally located at the northeast corner of State Road #23 and New Energy Drive. An Annexation Map, Map 1, can be found in the Appendix. B. Legal Description The Annexation Area is part of the Northwest Quarter of Section 22, Township 37 North, Range 2 East, Portage Township, St. Joseph County, Indiana. A complete legal description for the Annexation Area can be found in the Appendix, Table 1. C. Contiguity. The Annexation Area is at least one - fourth 1/4 (25 %) contiguous to the current City of South Bend limits: Contiguous Non - Contiguous Total 7159.1 feet 2216.1 feet 9375.2 feet 76.4% 23.6% 100.00% D. Size and Topography The Annexation Area is approximately 50.7 acres. The area is relatively flat. E. Buildings and Land Use There is one structure on the site, a storage -type building. The remainder of the site is vacant. Annexation Area F. Zoning & Subdivisions The site is currently zoned "A" Agriculture in unincorporated St. Joseph County. Upon annexation, the Area Plan Commission will propose a zoning plan for the Annexation Area. The South Bend Common Council will have final approval following established procedures for the zoning of property. The site is not subdivided. G. Population and Density There is no population, and zero population density in the Annexation Area. H. Tax Rate The tax rates used are those of 1995 payable in 1996. The Township Rate will decrease by $1.0026 per $100.00 of assessed valuation with the deletion of the Fire Fighting Fund, Fire Debt Fund and Cumulative Fire assessments, The tax rate for the Annexation Area will increase by the addition of the City and Town Rate, the Redevelopment District Rate and the South Bend Transpo Rate. The net increase in property taxes will be $6.0313 per $100.00 of assessed valuation. Table 2, located in the back of this Fiscal Plan, shows representative tax rate information as published by the St. Joseph County Auditor. I. Assessments Net Assessment 1995 payable 1996, St. Joseph County Auditor property tax records: Net Assessment: $110,500.00 I Councilmanic District The Annexation Area will be in Councilmanic District 6. Annexation Area K. Comparable Area 8 The area located north of Calvert Street and west of Olive Road is comparable to the Annexation Area in terms of its topography, patterns of land use, and population density. Annexation Area Topography: generally flat Land Use: vacant, one structure Zoning: "A" Agriculture Density: zero (0) persons /acre Comparable Area generally flat vacant, open field "E" Heavy Industrial zero (0) persons /acre The City will provide services to the Annexation Area in a manner equivalent in standard and scope to those provided within the comparable area. L. Hiring Plan It is anticipated that this annexation will not result in the elimination of jobs for employees of any other governmental entities. SECTION III. MUNICIPAL SERVICES A. Public Works Existing Sanitary Sewer Location New Energy Drive 12 -inch located in the east right -of -way Existing Water Mains West Calvert Street 12 -inch main New Energy Drive 12 -inch stub from Calvert Street Existing Storm Sewers New Energy Drive 21 -inch located in the east right -of -way Extensions of, or taps into sanitary sewer and water lines shall be governed by I.C. 36- 9 -22 -2, I.C. 8 -1.5 -3 and -4, and the rules and regulations of the South Bend Water Works and Sewer Utility. Annexation Area B. Police Department The Annexation Area will be added to Beat 25. Police coverage can be expected to begin shortly after the effective date of the annexation. Police patrols, traffic enforcement and emergency responses will be part of the services the City will offer to the area. Police services and response time in this area can be expected to be comparable and consistent with that as in other parts of the City. C. Fire Department The South Bend Fire Department does not foresee any unusual fire protection problems related to this annexation. The Annexation Area is located approximately 1 mile from Station #5, located at 2121 Prairie Avenue. Additional Fire Department units would respond including Engine #1 located approximately 2.5 miles away at 701 West Sample Street. Fire officials note that response times will be comparable to other areas of the City, and that no additional equipment will need to be purchased or personnel hired to service the Annexation Area. D. Code Enforcement The Department of Code Enforcement can provide services to the Annexation Area with a response time that is similar to the rest of the City. E. Administrative Services The incorporation of the Annexation Area will not effect the provision of other services currently provided to this property on a county-wide basis. The St. Joseph County Health Department, the St. Joseph County Public Library, the Area Plan Commission and the St. Joseph County/South Bend Building Department are some of the county-wide agencies that will continue to provide the same type and level of services to the Annexation Area. SECTION IV. FISCAL IMPACT The cost of providing city sery ices to the Annexation Area can be absorbed by Department budgets. The resolution indicates the approval and adoption by the Common Council of the writen plan and policy attached thereto concerning the provision of services, both capital and non- capital in nature, to the territory to be annexed. I would ask that the attached resolution be considered under the Special Business agenda item of the agenda of the Common Council meeting at which the companion ordinance is given public hearing, final reading and vote.
