RESOLUTION NO. a Y � 3✓ % <br />A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY <br />RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF <br />SOUTH BEND, INDIANA, COMMONLY KNOWN AS <br />2422 VIRIDIAN DRIVE <br />TO BE AN ECONOMIC REVITALIZATION <br />AREA FOR PURPOSES OF A THREE (3) YEAR REAL <br />PROPERTY TAX ABATEMENT FOR <br />JOHN R. AND LAI -LO GOULD <br />WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a <br />Declaratory Resolution designating certain areas within the City as Economic Revitalization <br />Areas for the purpose of tax abatement consideration; and <br />WHEREAS, a Declaratory Resolution designated the area commonly known as 2422 <br />Viridian Drive and which is more particularly described as follows: <br />That part of the Southeast quarter of Section 28, T. 38 N., R. 2 E., City of <br />South Bend, St. Joseph County, Indiana which is described as: Beginning at a <br />Point which is the intersection of the West Right of Way line of Bendix Drive <br />and the North line of Viridian Drive which is N. 00 °- 02' -06" W., 771.89 ft. <br />from a Point on the South line of said Section which is N. 90 °- 00' -00" W. <br />(assumed bearing), 40.00 ft. from an Iron in a Monument Box marking the <br />Southeast Corner of said Section; thence around a 40.00 ft. Radius curve to <br />the Right an Arc distance of 72.33 ft. to the end of a chord which bears S. <br />51 °- 46' -11" W. and having a distance of 62.87 ft.; thence around a 210.00 ft. <br />Radius curve to the Right an Arc distance of 77.97 ft. to the end of a chord <br />which bears N. 65 °- 47' -20" W. and having a distance of 77.52 ft.; thence <br />around a 586.97 ft. Radius curve to the Left an Arc distance of 357.00 ft. to <br />the end of a chord which bears N. 72 °- 34' -35" W. and having a distance of <br />351.52 ft.; thence S. 90 °- 00' -00" W., 268.26 ft.; thence N. 00 °- 22' -17" E., <br />169.87 ft.; thence N. 69 °- 21' -01" E., 771.91 ft. (771.89 ft., Record); thence <br />S. 00 °- 02' -06" E., 152.84 ft.; thence S. 90 °- 00' -00" W., 125.00 ft.; thence S. <br />00 °- 02' -06" E., 264.00 ft.; thence N. 900- 00' -00" E., 125.00 ft.; thence S. <br />00 °- 02' -06" E., 123.38 ft. To the Point of Beginning. Containing 4.92 <br />Acres. <br />with said real estate having the following Key No.: 25- 1010- 040804, as an Economic <br />Revitalization Area; and <br />WHEREAS, notice of the adoption of a Declaratory Resolution and the public <br />hearing before the Council has been published pursuant to Indiana Code 6- 1.1 -12.1- <br />2.5; and <br />WHEREAS, the Council held a public hearing for the purposes of hearing all <br />remonstrances and objections from interested persons; and <br />WHEREAS, the Council has determined that the qualifications for an <br />economic revitalization area have been met; and <br />WHEREAS, the Council issued a Confirmatory Resolution confirming the <br />adoption of the Declaratory Resolution as Resolution No. 2215 -95 on January 23, <br />1995; and <br />WHEREAS, the Petitioner has requested an additional period of time to <br />complete construction of the planned project. <br />
