<br />RESOLUTION OF THE SOUTH BEND COMMON COUNCIL
<br />DETERMINING, AFTER INVESTIGATION, THAT THE LEASE OF
<br />OFFICE SPACE FOR THE OFFICES OF THE CITY OF SOUTH BEND
<br />DEPARTMENT OF ECONOMIC DEVELOPMENT, DIVISION OF PLANNING
<br />IS NECESSARY
<br />WHEREAS, the Board of Public Works of the City of South Bend,
<br />Indiana ( "Board "), on October 28, 1996, received a Petition signed by
<br />fifty (50) owners of real property of the City of South Bend,
<br />requesting that the Board provide office space for the offices of the
<br />City of South Bend, Department of Economic Development, Division of
<br />Planning, by entering into a Lease Agreement with the 1st Source Bank
<br />of South Bend, Indiana, for approximately 2498 square feet within the
<br />building known as the First Bank Building, 205 West Jefferson
<br />Boulevard, South Bend, Indiana, for a term of one (1) year, with an
<br />annual rental of Twenty -seven Thousand Four Hundred Seventy -eight
<br />Dollars ($27,478.00) with an option to renew for two (2) additional
<br />one -year (1) periods years at this same rental; and
<br />WHEREAS, the Board also received, on October 28, 1996, a
<br />certificate of the St. Joseph County Auditor certifying that the
<br />verifier of the Petition and the signatories of the petition are
<br />taxpayers of property located within the corporate limits of the City
<br />of South Bend; and
<br />WHEREAS, pursuant to IC 36- 1 -10 -7 (2) requires, prior to the Board
<br />of Public Works entering into such a lease agreement, that the Common
<br />Council, after investigation, determine that the same is needed.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND COMMON COUNCIL,
<br />AS FOLLOWS:
<br />1. That the Common Council has conducted a public hearing on this
<br />resolution, and has heard persons desiring to speak in favor and
<br />opposed to the adoption of this resolution.
<br />2. That the Common Council finds that the City of South Bend does
<br />not have adequate space available in the County -City Building located
<br />at 227 West Jefferson Boulevard, South Bend, Indiana, to house the
<br />staff and operations of the Department of Economic Development,
<br />Division of Planning ( "Department ").
<br />3. That the most efficient and cost effective allocation of
<br />resources warrants the continued lease of office space outside the
<br />County -City Building.
<br />4. That approximately 2498 square feet of office space is
<br />available within the building known as the First Bank Building, 205
<br />West Jefferson Boulevard, South Bend, Indiana, and is proposed to be
<br />leased to the City of South Bend for the use of the Department.
<br />5. That on October 28, 1996, a petition signed by fifty (50)
<br />taxpayers of the City of South Bend, Indiana, was filed with the Board
<br />of Public Works of the City of South Bend, Indiana requesting that it
<br />provide office space for the offices of the City of South Bend,
<br />Department of Economic Development, Division of Planning, by entering
<br />into a lease agreement with the 1st Source Bank of South Bend,
<br />Indiana, for approximately 2498 square feet within the building known
<br />as the First Bank Building, 205 West Jefferson Boulevard, South Bend,
<br />Indiana, for an annual rental of Twenty -seven Thousand Four Hundred
<br />Seventy -eight Dollars ($27,458.00).
<br />6. That on October 28, 1996, the Board of Public Works received a
<br />certificate signed by the St. Joseph County Auditor, certifying that
<br />the verifier and the signatories of the petition are taxpayers of
<br />property located within the corporate limits of the City of South
<br />Bend.
