RESOLUTION NO. QLO- <br />A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY <br />RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF <br />SOUTH BEND, INDIANA, COMMONLY KNOWN AS <br />250 EAST SAMPLE STREET <br />TO BE AN ECONOMIC REVITALIZATION AREA FOR PURPOSES <br />OF A SIX (6) YEAR REAL PROPERTY TAX ABATEMENT FOR <br />THE SOUTH BEND REDEVELOPMENT COMMISSION <br />FOR THE BENEFIT OF: <br />DAVIS AND GROOMS, AN INDIANA PARTNERSHIP <br />WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a <br />Declaratory Resolution designating certain areas within the City as Economic Revitalization <br />Areas for the purpose of tax abatement consideration; and <br />WHEREAS, a Declaratory Resolution designated the area commonly known as 250 <br />East Sample Street and which is more particularly described as follows: <br />PARCEL I: LOTS NUMBERED ONE (1), TWO (2) AND THREE (3) AS <br />SHOWN ON THE RECORDED PLAT OF MARY HUTCHINS' ADDITION <br />TO THE CITY OF SOUTH BEND, RECORDED IN PLAT BOOK 2, PAGE <br />67, TOGETHER WITH THE EAST AND WEST ALLEY LYING SOUTH OF <br />LOTS 1 AND 2 AND NORTH OF LOT 3 OF SAID LOTS. <br />ALSO, <br />A LOT OR PARCEL OF LAND IN THE EAST HALF OF THE NORTHWEST <br />QUARTER OF SECTION 13, TOWNSHIP 37 NORTH, RANGE 2 EAST, <br />NOW WITHIN AND A PART OF THE CITY OF SOUTH BEND, IN ST. <br />JOSEPH COUNTY, INDIANA, DESCRIBED AS BEGINNING AT A POINT <br />36 RODS, 3 FEET AND 10 INCHES WEST OF THE NORTHEAST CORNER <br />OF THE NORTHWEST QUARTER OF SAID SECTION 13; THENCE <br />RUNNING WEST ON THE NORTH LINE OF SAID SECTION A DISTANCE <br />OF 28 FEET; THENCE TO THE PLACE OF BEGINNING, EXCEPTING <br />THEREFROM THAT PART TAKEN OFF OF THE NORTH END THEREOF <br />FOR SAMPLE STREET. <br />PARCEL lI: A PARCEL OF LAND IN THE NORTHWEST QUARTER OF <br />SECTION 13, TOWNSHIP 37 NORTH, RANGE 2 EAST, DESCRIBED AS <br />FOLLOWS: BEGINNING AT A POINT 40 RODS, 13 FEET AND 10 INCHES <br />WEST OF THE NORTHEAST CORNER OF THE NORTHWEST QUARTER <br />OF SECTION 13, WHICH POINT IS IN THE CENTER LINE OF SAMPLE <br />STREET; THENCE EAST ON SAID LINE 48 FEET; THENCE SOUTH 10 <br />RODS AND 31 LINKS; THENCE WEST 43 FEET; THENCE NORTH 10 <br />RODS AND 31 LINKS TO THE PLACE OF BEGINNING. <br />and which has Key Numbers 18- 7001 -0001, 18 -7001 -0002, and 18- 7008 -0277 as an Economic <br />Revitalization Area; and <br />WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing <br />before the Council has been published pursuant to Indiana Code 6- 1.1- 12.1 -2.5; and <br />WHEREAS, the Council held a public hearing for the purposes of hearing all <br />remonstrances and objections from interested persons; and <br />
