WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a Declaratory Resolution designating certain areas within the City as Economic Revitalization Areas for the purpose of tax abatement consideration; and WHEREAS, a Declaratory Resolution designated the area commonly known as 3300 North Kenmore Street, South Bend, Indiana, and which is more particularly described as follows: commencing at the Northeast corner of Section 28; thence South 89°48'OS" West, 966.00 feet along the North line of said Section 28; thence South 00°00'23" West 40.00 feet to the South boundary of Cleveland Road; thence South 89°48'OS" West, 289.0-0 feet along said South boundary; thence South 44°54' 14" West, 14.17 feet to the East boundary of Kenmore Street; thence South 00°00'23" West, 146.76 feet along said East boundary; thence along said East boundary, Southeasterly 294.37 feet along an arc to the left, having a radius of 1,869.86 feet, subtended by a long chord, having a bearing of South 04°30' 13" East, and a length of 294.07 feet to the point of beginning of this description; thence North 89°48'OS" East 581.88 feet; thence South 00°00'23" West, 472.86 feet; thence South 89°58'S6" West, 498.99 feet to said East boundary of Kenmore Street; thence North 09°S9'37" West, 445.88 feet along said East boundary; thence Northwesterly 31.98 feet along an arc to the right, having a radius of 1,869.86 feet and subtended by a long chord, having a bearing of North 09°30' 1 S" West, and a length of 31.98 feet to the place of beginning and which has Key Number 25-1010-0385.18, as an Economic Revitalization Area; and WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing before the Council has been published pursuant to Indiana Code 6-1.1-12.1-2.5; and WHEREAS, the Council held a public hearing for the purposes of hearing all remonstrance's and objections from interested persons; and WHEREAS, the Council has determined that the qualifications for an economic revitalization area have been met. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. The Common Council hereby confirms its Declaratory Resolution designating the area described herein as an Economic Revitalization Area for the purposes of tax abatement. Such designation is for Real property tax abatement only and is limited to two (2) calendar years from the date of adoption of the Declaratory Resolution by the Common Council. SECTION II. The Common Council hereby determines that the property owner is qualified for and is granted Real property tax deduction for a period of (4) four years, and further determines that the petition, the Memorandum of Agreement between the Petitioner and the City of South Bend, and the Statement of Benefits comply with Chapter 2, Article 6, of the Municipal Code of the City of South Bend and Indiana Code 6-1.1-12 et sea. SECTION III. The petitioner, Elkhart Plastics proposes to increase office space by 6,500 square feet and remodel an existing 3,700 square feet. DATE: November 2, 2006 On October 18, 2006, a petition for real property tax abatement consideration for property located at 3300 N. Kenmore Street was filed with the City Clerk by Elkhart Plastics, Inc. Pursuant to Chapter 2, Article 6, Section 2-82 of the Municipal Code of the City of South Bend, this petition was referred to the Department of Community and Economic Development for purposes of investigation and preparation of a report determining whether the area qualifies as an Economic Revitalization Area pursuant to I.C.6-1.1-12.1 and whether all zoning requirements have been met. The Department of Community and Economic Development has reviewed the petition (a copy of which is attached), investigated the area, and makes the following report. PROJECT SUMMARY Elkhart Plastics is a custom plastic processor, utilizing a rotational molding process. Products manufactured include yellow crash barrels for highway safety and a wide variety of large, hollow products shipped up to 500 miles away. The company plans to increase office space by 6,500 square feet and remodel an existing 3,700 square feet to serve as the North American headquarters for Promens, which is the largest rotational molding company in the world and is headquartered in Reykjavik, Iceland. New construction guidelines for Industrial, City-Wide is 10,000 square feet as is rehabilitation. The combined remodeling and additional office space totals 10,200 square feet. The Department of Community & Economic Development believes the intent of the current tax abatement ordinance was 10,000 square feet, whether it is new construction, rehab, or a combination. November 2, 2006 Page 2 growth of the company. The estimated cost of the addition and remodel is $600,000. Total taxes to be abated during the (4) four-year abatement period is estimated at $51,270. Total taxes to be paid during the (4) four-year abatement period is estimated at $30,762. EMPLOYMENT IMPACT Per the petition, it is estimated that the total prof ect will create (20) twenty new, permanent, full-time jobs representing a new annual payroll of $1,000,000. The project will also maintain (40) forty existing, permanent, full-time jobs representing an annual payroll of $1,300,000. ABATEMENT QUALIFICATION A review of the tax abatements previously granted, finds that the petitioner has not been granted or associated with any previous tax abatements: 2. The Building Commissioner has reviewed the petition and finds the property to be properly zoned for the proposed project. 3. A review of the South Bend Redevelopment designation areas finds that the property is located in the Airport Economic Development Area, which is a Tax Incremental Allocation Area; therefore, the petition for real property tax abatement must f rst be approved by the South Bend Redevelopment Commission. 4. A review of the Tax Abatement Ordinance No. 9394-0 finds that the petitioner does meet the qualifications fora (4) four-year real property tax abatement under Section 2-82, Industrial Development City-Wide.
