Parkway, South Bend, Indiana 46619 (mailing address: 159 N. Summit Drive, South Bend, IN 46619) Whereas, Indiana Code Section 36 -7 -4 -918.6 requires the Common Council to give notice pursuant to Indiana Code Section 5- 14- 1.5 -5, of its intention to consider Petitions from the Board of Zoning Appeals for approval or disapproval; and Whereas, the Common Council must take action within thirty (30) days after the Board of Zoning Appeals makes its recommendation to the Council; and Whereas, the Common Council is required to make a determination in writing on such requests pursuant to Indiana Code Section 36 -7-4- 918.4; and Whereas, the South Bend Board of Zoning Appeals has made a recommendation, pursuant to applicable state law. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: Section I. The Common Council has provided notice of the hearing on the Petition from the Board of Zoning Appeals pursuant to Indiana Code Section 5- 14- 1.5 -5, requesting that a special exception be granted for the property located at Lot J, Belleville Gardens, west of Dogwood and S. Parkway, South Bend, Indiana 46619 (Mailing address: 159 N. Summit Drive, South Bend, IN 46619) in order to permit a fair and carnival in "A" Residential. Section H. Following a presentation by the Petitioner, and after proper public hearing, the Common Council hereby approves the Petition of the South Bend Board of Zoning Appeals, a copy of which is on file in the Office of the City Clerk. Section III. The Common Council of the City of South Bend, Indiana hereby finds that: 1. The approval will not be injurious to the public health, safety, morals, and general welfare of the community; 2. The use and value of the area adjacent to the property included in the special exception will not be affected in a substantially adverse manner; 3. The need for the special exception arises from specific conditions peculiar to the property involved; 4. The strict application of the terms of the Zoning Ordinance will constitute an unnecessary hardship if applied to the property for which this special exception is sought; and 5. The approval does not interfere substantially with the, Comprehensive Plan adopted by the City of South Bend. Section W. Approval is subject to the Petitioner complying with the reasonable conditions established by the Board of Zoning Appeals which are on file in the office of the City Clerk. Section V. This Resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. The use and value of the area adjacent to the property will not be affected in a substantially adverse manner. All activities, including parking, will take place on the property. Events should be concluded by 10:00 p.m. each evening. Alcohol will not be sold or permitted on the property. The need for the special exception arises from the property being located in the City of South Bend, Indiana and being zoned "A" Residential. The strict application of the terms of the zoning ordinance will constitute an unnecessary hardship as the parish would not be able to hold a major fund- raising endeavor. Zoned "A" Residential and in the "A" Height and Area. Dear Council Members: The above referenced petition of St. Mary's Polish National Catholic Church was legally advertised on August 1, 1997. The Board of Zoning Appeals of the City of South Bend gave it a public hearing on August 21, 1997, at which time the following action was taken: Upon a motion by Ms. Watkins, being seconded by Mr. Borders and unanimously carried, the petition for Special Exception to allow a fair /carnival in "A" Residential on property located on the west side of Dogwood Drive at Garden Lane is sent to the City of South Bend Common Council with a Favorable Recommendation. The deliberations of the Board of Zoning Appeals and points considered in arriving at the above decision are shown in the Minutes of the Public Hearing, and will be forwarded to you at a later date, to be made a pert of this report. MARY'S NATIONAL POLISH CHURCH SPECIAL EXCEPTION PURSUANT 21 -111 BOARD OF ZONING APPEALS CITY OF SOUTH BEND FINDINGS OF FACT 1. The establishment, maintenance, or operation of the Special Exception will not be detrimental to or endanger the public health, safety, morals, comfort, or general welfare because: A 100' setback from Residential Property for all activities will be maintained. Also, this carnival is temporary only one weekend a year being held on 10 acres of property. 2. The Special Exception will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purpose already permitted, nor substantially diminish and impair property values within the neighborhood because: Carnival is one weekend a year and temporary only. Parking will be on paved Belleville lot. 3. The establishment of the Special Exception will not impede the normal and orderly development and improvement of the surrounding property for uses permitted in the district because: Carnival is only temporary one weekend a year, It will not continue Past 10.00 n m nightly. 4. Adequate utilities, access roads, drainage and /or necessary facilities have been or are being provided because: will be accessing through Belleville Park off of Mayflower Road 5. Adequate measures have been or will be taken to provide ingress and egress so designated as to minimize traffic congestion in the public streets because: will be accessing through Belleville Park off of Mayflower Road.
