RESOLUTION NO. <br />A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY <br />RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF <br />SOUTH BEND, INDIANA, COMMONLY KNOWN AS <br />4044 William Richardson Court <br />TO BE AN ECONOMIC REVITALIZATION AREA FOR <br />PURPOSES OF A THREE (3) YEAR REAL <br />PROPERTY TAX ABATEMENT FOR <br />RICK E. NEWMAN (CRYSTAL MOUNTAIN, INC.) <br />WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a Declaratory <br />Resolution designating certain areas within the City as Economic Revitalization Areas for the purpose of tax <br />abatement consideration; and <br />WHEREAS, a Declaratory Resolution designated the area commonly known as 4044 William <br />Richardson Court, South Bend, Indiana, and which is more particularly described as follows: <br />THAT PART OF THE NORTHEAST QUARTER OF SECTION 21, T. 38 N., R. 2 E., GERMAN <br />TOWNSHIP, CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA WHICH IS DESCRIBED <br />AS: BEGINNING AT A POINT ON THE EAST LINE OF SAID SECTION WHICH IS N. 00° - 50' -42" <br />W., 315.78 FT. FROM A STONE MARKING THE EAST QUARTER POST OF SAID SECTION; <br />THENCE S. 88° -53' -01" W., 347.61 FT. TO THE EAST LINE OF WILLIAM RICHARDSON <br />COURT; THENCE ALONG SAID EAST LINE N. 00° - 59' -02" W., 4.91 FT; THENCE AROUND A <br />60.00 FT. RADIUS CURVE TO THE LEFT AN ARC DISTANCE OF 52.86 FT. TO THE END OF A <br />CHORD WHICH BEARS N. 260 -13'-24" W. AND HAVING A DISTANCE OF 51.17 FT.; THENCE <br />AROUND A 50.00 FT. RADIUS CURVE TO THE RIGHT AN ARC DISTANCE OF 44.05 FT. TO <br />THE END OF A CHORD WHICH BEARS N. 26° -13' 24" W. AND HAVING A DISTANCE OF 42.64 <br />FT.; THENCE N. 000 -59' -02" W., 255.14 FT.; THENCE N. 880 -53' -01" E., 388.45 FT. TO THE <br />EAST LINE OF SAID SECTION; THENCE ALONG SAID EAST LINE S. 00° -50'42" E., 345.00 FT. <br />TO THE POINT OF BEGINNING. CONTAINING 3.0283 ACRES. <br />and which has Key Number 25- 1013 -0216, as an Economic Revitalization Area; and <br />WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing before the <br />Council has been published pursuant to Indiana Code 6 -1.1- 12.1 -2.5; and <br />WHEREAS, the Council held a public hearing for the purposes of hearing all remonstrances and <br />objections from interested persons; and <br />
