REGULAR MEETING FEBRUARY 10, 2015 31 <br />APPROVAL OF REVOCABLE PERMIT FOR ENCROACHMENT — COLFAX HILL <br />PARTNERS. LLC <br />Mr. Gilot stated a Revocable Permit has been received for the purpose of allowing access ramps <br />and stairs, retaining wall, and an outdoor seating area to be installed in the right -of -way at Colfax <br />Ave. and Hill Streets, by Colfax IIill Partners, LLC, 1115 Burns St., South Bend, Indiana. The <br />encroachment shall remain in the right of way until the time as the Board of Public Works of the <br />City of South Bend shall determine that such encroachment is in any way impairing or <br />interfering with the highway or with the free and same flow of traffic. Engineering stated the <br />applicant shall adhere to both Building Department and Engineering Department design <br />requirements; they must install railings as appropriate; there must be adequate lighting; the <br />sidewalk must be extended to the curb line to maintain ADA width requirements; and a Sidewalk <br />Cafe permit must be applied for each year if that is the purpose of the outdoor seating area. <br />Upon a motion made by Ms. Roos, seconded by Mr. Hemborn and carried, the Revocable Permit <br />was approved. <br />SOUTHEPtN RAILROAD ON THE NORTII SCOTT STREE'1' THE EAST AND <br />INDIANA AVENUE ON THE SOUTH <br />Mr. (Mot indicated that Danch, Harper & Associates, on behalf of the City of South Bend, has <br />submitted a request to vacate the above referenced alleys and streets. Mr. Gilot advised the <br />Board is in receipt of favorable recommendations concerning this Vacation Petition from the <br />Area Plan Commission, Police Department, Fire Department, Solid Waste, Community <br />Investment, and Engineering. Area Plan stated the vacation would not hinder the growth or <br />orderly development of the unit or neighborhood in which it is located or to which it is <br />contiguous. The vacation would not make access to the lands of the aggrieved person by means <br />of public way difficult or inconvenient. The vacation would not hinder the public's access to a <br />church, . school or other public building or place. The vacation would not hinder the rise of a <br />public right -of -way by the neighborhood in which it is located or to which it is contiguous. <br />Therefore, Ms. Roos made a motion recommending approval of the request for vacation. Mr. <br />Roles seconded the motion which carried. <br />APPROVE TRAFFIC CONTROL DEVICES <br />Upon a motion made by Ms. Roos, seconded by Mr. Henthom and carried, the following traffic <br />control devices were approved: <br />NEW INSTALLATION: Handicapped Accessible Parking Space Signs <br />LOCATION: 832 South 26th Street <br />1114 East Bowman <br />REMARKS: All criteria has been met. <br />RENEWAL: Reserved Handicap Parking Permit <br />LOCATION: Handicap Permit Spot No. 3 in front of <br />County -City Building —Irvin Smith <br />REMARKS: All criteria has been met. <br />APPROVE TRAFFIC CALMING PLAN — W ALNIJT GROVE <br />Mr. Gilot stated at the Board of Works meeting on Thursday Mr. Eric IIorvath, Public Works <br />Director, spoke regarding the Engineering Department's recommendations for traffic calming in <br />the Walnut Grove neighborhood. He stated the Board heard those in favor and those opposed to <br />the traffic calming plan speak, and held public discussions. Therefore, be stated, the Board will <br />not repeat the information already presented by the residents, but if anyone had anything of value <br />to add, the Board would allow one person to speak on behalf of those in favor and one person to <br />speak on behalf of those opposed. He noted he would allow the City Engineer, Corbitt Kerr to <br />speak first if there are any changes to the City's recommendation, and speak after those opposed <br />and those in favor have had a chance to speak, to address any comments or questions. Mr. Kerr <br />stated that after receiving lots of public input via emails, letters, phone calls, and public <br />meetings, the City has only one adjustment to their proposed plan which is to add "and/or 20h <br />Street" for the potential installation of a street hump. He noted this would allow the City to make <br />the determination if and where it could be put on 26" Street. Mr. Gilot informed those present <br />that Mr. Kerr, as the City Engineer, has a big responsibility for traffic decisions.
