RESOLUTION NO. <br />A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY <br />RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF <br />SOUTH BEND, INDIANA, COMMONLY KNOWN AS <br />3601 GAGNON <br />TO BE AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF A <br />FIVE (5) YEAR PERSONAL PROPERTY TAX ABATEMENT FOR <br />JOURNEYMAN TOOL & MOLD, INC. <br />WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a Declaratory <br />Resolution designating certain areas within the City as Economic Revitalization Areas for the purpose of tax <br />abatement consideration; and <br />WHEREAS, a Declaratory Resolution designated the area commonly known as 3601 Gagnon and <br />which is more particularly described as follows: <br />THAT PART OF THE NORTHEAST QUARTER OF SECTION 28, TOWNSHIP 38 NORTH, RANGE 2 <br />EAST, GERMAN TOWNSHIP, CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA WHICH IS <br />DESCRIBED AS: BEGINNING AT A 5/8" CAPPED REBAR SET ON THE NORTH LINE OF GAGNON <br />STREET WHICH IS N. 00 °- 00' -37" E., (N. 00 °- 00' -23" E., RECORD) 35.00 FT. FROM A POINT ON <br />THE CENTERLINE OF GAGNON STREET WHICH IS S. 890- 58' -39" W. (N. 89 °- 59' -37" W., <br />RECORD), 370.00 FT. FROM A POINT AT THE INTERSECTION OF THE CENTERLINE OF <br />GAGNON STREET WITH THE CENTERLINE OF KENMORE STREET WHICH IS N. 000- 00' -38" E., <br />(N. 00 °- 00' -23" E., RECORD) 966.00 FT. FROM A POINT ON THE SOUTH LINE OF THE <br />NORTHEAST QUARTER OF SAID SECTION WHICH IS S. 89 °- 58' -56" W., (RECORD AND <br />ASSUMED BEARING), 1150.08 FT. (1150.09 FT., RECORD) FROM AN IRON PIPE FOUND IN A <br />MONUMENT BOX MARKING THE SOUTHEAST CORNER OF THE NORTHEAST QUARTER OF <br />SAID SECTION; THENCE ALONG THE NORTH LINE OF GAGNON STREET S. 89 °- 58' -39" W., (N. <br />89 °- 59' -37" W., RECORD) 150.01 FT. TO A SET 5/8" CAPPED REBAR; THENCE N. 00 °- 00' -43" E., <br />(N. 00 °- 00' -23" E., 363.45 FT. (363.60 FT., RECORD) TO A SET 5/8" CAPPED REBAR; THENCE <br />NORTH 890- 58' -40" E., 150.00 FT. (S. 89 °- 59' -37" E., RECORD) TO A SET 5/8" CAPPED REBAR; <br />THENCE S. 000- 00' -37" W., 363.45 FT. (S. 00 °- 00' -17" W., 363.60 FT., RECORD) TO THE POINT OF <br />BEGINNING. <br />CONTAINING 1.25 ACRES AND COMPRISED OF ONE (1) LOT. <br />SUBJECT TO ALL LEGAL HIGHWAYS, EASEMENTS AND RESTRICTIONS OF RECORD. <br />and which has Key Number 25 -1010- 0385.08, as an Economic Revitalization Area; and <br />WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing before the <br />Council has been published pursuant to Indiana Code 6 -1.1- 12.1 -2.5; and <br />
