RESOLUTION NO. <br />A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY <br />RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF <br />SOUTH BEND, INDIANA, COMMONLY KNOWN AS <br />3702 WEST SAMPLE STREET <br />TO BE AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF A <br />FIVE (5) YEAR PERSONAL PROPERTY TAX ABATEMENT FOR <br />MAVERICK PACKAGING, INC. <br />WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a <br />Declaratory Resolution designating certain areas within the City as Economic Revitalization <br />Areas for the purpose of tax abatement consideration; and <br />WHEREAS, a Declaratory Resolution designated the area commonly known as 3702 <br />West Sample Street and which is more particularly described as follows: <br />That part of the Northeast quarter of Section 16, T. 37 N., R. 2E., City of South Bend, St. <br />Joseph County, which is described as: From the Northwest Corner of the East half of the <br />Northeast quarter of said Section measure South 90 deg. 00 min. 00 see. West along the <br />North line of said Section 630 ft. and South 00 deg. 02 min. 31 sec. E., 40.00 ft. and north 90 <br />deg. 00 min., 00 sec. East 300.02 ft. (300.00 ft. Record) and South 00 deg. 04 min. 00 sec. <br />West, 579.33 ft. (S. 00 deg. 01 min. 52 sec. W., 579.125 ft., Record) and north 89 deg. 25 <br />min. 13 see. East 13.64 ft. (North 89 deg. 59 min. 13 sec. East 13.745 ft., Record) and South <br />00 deg. 00 min. 38 sec. east 280.27 ft to the Point of Beginning of this description; thence <br />South 89 deg. 55 min. 49 sec. West along the North line of Industrial Ave. (now vacated), <br />159.99 ft.; thence South 00 deg. 03 min. 24 sec. West 400.60 ft.; thence South 89 deg. 55 <br />min. 41 sec. East along the Northerly line of the New Jersey, Indiana and Illinois Railroad, <br />289.00 ft., thence North 00 deg. 03 min., 24 sec. East, 363.03 ft. (N.00 deg. 01 min. 48 sec. (n. 00 deg. <br />02 min. 16 sec. W Record) to the Point of Beginning. Containing 2.5472 acres. <br />with said real estate having the following Key Number 18- 35198- 09194, as an Economic <br />Revitalization Area; and <br />WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing <br />before the Council has been published pursuant to Indiana Code 6 -1.1- 12.1 -2.5; and <br />WHEREAS, the Council held a public hearing for the purposes of hearing all <br />remonstrances and objections from interested persons; and <br />WHEREAS, the Council has determined that the qualifications for an economic <br />revitalization area have been met. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South <br />Bend, Indiana, as follows: <br />SECTION I. The Common Council hereby confirms its Declaratory Resolution designating the <br />area described herein as an Economic Revitalization Area for the purposes of tax abatement. <br />Such designation is for Personal property tax abatement only and is limited to two (2) calendar <br />years from the date of adoption of the Declaratory Resolution by the Common Council. <br />
