Resolution No. 2866-00 <br />A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, APPOINTING AN ADVISORY CITY NEGOTIATING TEAM TO REPRESENT <br />THE CITY ADMINISTRATION AND THE COMMON COUNCIL FOR THE 2000 <br />FIREFIGHTER NEGOTIATIONS <br />"61 h"COS, the legislative body of the city has the mandatory duty to fix by ordinance the <br />annual compensation for members of the South Bend Fire Department pursuant tolndiana Code <br />§ 36- 8- 3 -3(d); and <br />04M$, the Board of Public Safety has the exclusive right and obligation to oversee all <br />matters excluding compensation of the South Bend Fire Department pursuant to Indiana Cade § <br />36-8-3-2(b)(1); and <br />"411ijereai0, the City Administration and the Common Council have determined that a <br />unified effort would be in the City of South Bend's best interests when addressing, through the <br />negotiating process, such items as annual compensation, specialty pays, monetary fringe benefits, <br />working conditions and items related to the sworn members of the South Bend Fire Department; <br />and <br />Vbt,rCtt -5, the Common Council and the Board of Public Safety will each take formal <br />action by adopting similar resolutions which will officially appoint an advisory city negotiating <br />team which will represent each body, and provide and receive updates during executive sessions <br />called for the purpose of discussing strategy with regard to collective bargaining pursuant to <br />Indiana Code § 5- 14-1.5 -6.1; and <br />'UDI&VOS, the 1997 -2000 Collective Bargaining Agreement between the City and the <br />South Bend Firefighters' Association Local 362 of the International Association Firefighters AFL, <br />CIO expires at the end of this year, along with Ordinance No. 86-96 which established the <br />firefighter salaries and monetary fringe benefits for calendar years 1997 through 2000; and <br />WbitlMOS, the advisory City Negotiating Team shall not be considered a "governing <br />body" or "public agency" under Indiana Code § 5- 14- 1.5 -2. <br />]tobl, therefore, be it rVO4jWb bp tiie Colnmott Coutt>rij of * (Iritr of 0OUth <br />b, Jabian a, a g foTtowo: <br />Section I. The Common Council of the City of South Bend, Indiana, hereby appoints an <br />advisory City Negotiating Team to represent the City Administration and the Common Council for <br />the upcoming labor negotiations with the negotiating team representing the South Bend <br />Firefighters' Association Local # 362. <br />Section II. The members of the advisory City Negotiating Team shall be as follows: <br />James Aranowski, Council Member Roland Kelly, Council Member & Alternate <br />Thomas L. Bodnar, Esquire M. Catherine Roemer, City Controller <br />Kathleen Cekanski - Farrand, Spokesperson Andrew Ujdak, Council Member <br />Sheryl Green, Esquire Karen L. White, Council Member <br />
