A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND
ADOPTING A WRITTEN FISCAL PLAN AND ESTABLISHING A POLICY FOR THE
PROVISION OF SERVICES TO AN ANNEXED AREA IN WARREN AND GERMAN
TOWNSHIPS
(JAMES AND BARBARA KIDDER ANNEXATION)
WHEREAS, there has been submitted to the Common Council of the City of South Bend,
Indiana, an ordinance and a petition by more than 51 % of the property owners which proposes the
annexation of the real estate located in Warren and German Townships, St. Joseph County, Indiana,
more particularly described in Section I of this Resolution, which Ordinance also proposes a change
in zoning from "R" Residential, to "IP" Industrial Park, contingent upon the owners' submission of
a final site plan within one (1) year of annexation; and
WHEREAS, the territory proposed to be annexed encompasses approximately 108.74 acres
of vacant, undeveloped land having general boundaries on the southeast corner of Olive Road and
Indiana toll Road, which is more than 12.5% contiguous to the current City limits, i.e. approximately
27% contiguity. The development of the territory proposed to be annexed will require a basic level
of municipal public services, including police and fire protection, street and road maintenance,
sewage collection, solid waste and yard pickup as well as recycling services, and services of a capital
improvement nature, including construction of streets and roads, a sewer collection system, a water
distribution system, and a street lighting system; and
WHEREAS, the Common Council of the City of South Bend, Indiana, now desires to
establish and adopt a fiscal plan and establish a definite policy showing: (1) the cost estimates of
services of a non - capital nature, including street and road maintenance, police and fire protection,
and other non - capital services normally provided within the corporate boundaries, and services of
a capital improvement nature, including a sewer collection system, a water distribution system, and
a street lighting system; (2) the method (s) of financing those services; (3) the plan for the
organization and extension of those services; (4) that services of a non - capital nature will be
provided to the annexed area within one (1) year after the effective date of the annexation, and that
they will be provided in a manner in standard and scope to similar non - capital services provided to
areas within the corporate boundaries of the City of South Bend, regardless of similar topography,
patterns of land use, or population density; (5) that the services of a capital improvement nature will
be provided to the annexed area within four (4) years after the effective date of the annexation in the
same manner as the services are provided to areas within the corporate boundaries of the City of
South Bend, regardless of similar topography, patterns of land use, or population density, and in a
manner consistent with federal, state and local laws; and (6) the plan for hiring the employees of
other governmental entities whose jobs will be eliminated by the proposed annexation; and
WHEREAS, the Board of Public Works of the City of South Bend, the Board of Public
Safety of the City of South Bend, and the Board of Water Works Commissioners of the City of
South Bend, have each approved a written fiscal plan and established a policy for the provision of
services to the territory proposed to be annexed, which plan and policy the Common Council finds
to be appropriate and in the best interest of the City, and, which it desires to adopt.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY
OF SOUTH BEND, INDIANA, AS FOLLOWS:
Section I. It is in the best interest of the City of South Bend and the area proposed to be
annexed that the real property located in Warren and German Townships, St. Joseph County,
Indiana, described more particularly as follows, be annexed to the City of South Bend:
That Part of the Northeast and Southeast Quarters of Section 24, Township 38 North,
Range 1 East, Warren Township, and the Northwest Quarter of Section 19, Township
38 North, Range 2 East, German Township all in St. Joseph County, Indiana which
is described as:
Beginning at the East Quarter Post of said Section 24; thence N. 00 - 20' -57" E., 70.27
Ft. more or less along the North and South Quarter Line of said Section 24 and the
West Line of Lot 93 of the Plat of "Kidder's Olive Road Minor Subdivision" as
recorded by Document No. 9818752 in the Records of the St. Joseph County, Indiana
Recorder's Office to the southerly right -of -way line of the Indiana East -West Toll
Road; thence N. 89 - 47' -29" E. along the southerly line of said Toll Road and its
easterly extension, 1119.37 Ft. to the east line of Olive Road; thence N. 00 - 52' -04"
W. (Assumed Bearing), 300.00 Ft. more or less to the intersection of said east line
with the northerly Line of said Toll Road; thence S. 89 - 20' -23" W. along said
northerly line, 3795.28 Ft. more or less to the intersection of said northerly line with
the North and South Quarter Line of said Section 24; thence S. 00 - 08' -51" W.,
1603.00 Ft. more or less; thence S. 89 - 19' -02" E., 2471.39 Ft. more or less; thence
S. 00 - 40' -58" W., 535.40 Ft. more or less; thence N. 89 - 42' -48" E., 208.02 Ft. more
or less to the West Line of said Lot #3; thence along the West Line of said Lot #3,
N. 00 - 11' -18" E., 1765.66 Ft. more or less to the point of beginning. Containing
108.74 Acres More or Less. Subject to all legal highways, easements and restrictions
of record.
Section II. It shall be and hereby is now declared and established that it is the policy of the
City of South Bend, to furnish services to said territory of a non - capital nature, such as street and
road maintenance, police and fire protection, street sweeping, flushing, and snow removal, sewage
collection, solid waste and yard pick -up as well as recycling services, within one (1) year of the
effective date of the annexation, in a manner equivalent in standard and scope to the services
furnished by the City to other areas of the City regardless of similar topography, patterns of land use,
or population density; and to furnish to said territory services of a capital improvement nature, such
as a sewer collection system, a water distribution system (existing water main), street and road
construction , and a street lighting system, within four (4) years of the effective date of the
annexation in the same manner as those services are provided to areas within the corporate
boundaries of the City of South Bend regardless of similar topography, patterns of land use, or
population density, and in a manner consistent with federal, state and local laws, procedures, and
planning criteria.
Section III. The South Bend Common Council for the City of South Bend shall and does
hereby now establish and adopt the fiscal plan described in Exhibit "A ", attached hereto and made
a part hereof, for the famishing of said services to the territory to be annexed.
Section IV. This Resolution shall be in full force and effect from and of its date of adoption
by the Common Council and approval by the Mayor.

A. General
This Fiscal Plan represents the City of South Bend's (hereinafter, "City ") policy for the annexation
of property in Warren and German Townships, St. Joseph County (hereinafter, "Annexation
Area "), and was developed through the cooperative efforts of the Area Plan Commission and the
following City Departments:

Department of Community and Economic Development
Department of Administration and Finance
SECTION II. GENERAL DATA
A. Location
The Annexation Area is located on the south side of The Indiana East -West Toll Road,
approximately 1,000 feet west of Olive Road. See Map 1.
B. Legal Description
The Annexation Area is part of the Northeast & Southeast Quarters of Section 24, Township 38
North, Range 2 East, Warren Township, and the Northwest Quarter of Section 19, Township 38
North, Range 2 East, German Township, St. Joseph County, Indiana. For a complete legal
description see Table 1.
C. Contiguity
The Annexation Area is at least 1/8 (12.5 %) contiguous to the current City limits:

D. Size of Annexation Area
The Annexation Area is 108.74 acres in area. 26.14 acres of that is composed of the Indiana East -
West Toll Road.
E. Buildings and Land Use
There are no buildings on this site
F. Zoning & Subdivisions
The site is zoned "R" Residential in unincorporated St. Joseph County. The Area is proposed to
be zoned "IP" Industrial Park upon annexation. There is no recorded subdivision as of the date of
the preparation of this fiscal plan.
G. Population
There is no resident population within the Annexation Area.
H. Tax Rate
The tax rates used are those of 1999 payable in 2000, and apply to Warren Township only.
NOTE #1: There is no established tax rate for South Bend - Warren as of this date.
NOTE #2: That part of the annexation area that lies within German Township is entirely occupied
by the Indiana East -West Toll Road. Therefore, no computations have been done.
The Township Rate will decrease by $.5687 per $100.00 of assessed valuation with the deletion of
the Fire Fighting Fund and the Fire Debt Fund assessments.
The tax rate for the Annexation Area will increase by $7.7255 with the addition of the City and
Town Rate, the Redevelopment District Rate and the South Bend Transpo Rate.
The net increase in property taxes will be $7.1568 per $100.00 of assessed valuation. Table 2
shows representative tax rate information as published by the St. Joseph County Auditor.

The Annexation Area will be in the 1 st District.
K. Hiring Plan
It is anticipated that this annexation will not result in the elimination of jobs for employees of any
other govermnental entities. The Warren and German Township Trustees have been notified of
this annexation.
SECTION III. MUNICIPAL SERVICES
A. Public Works
Sewer - Existing sanitary sewers are located on both Olive Road and Cleveland Road. A sewer
extension will be required. The sewer extension will paid using Sewage Works funds.
Water - There is an existing 16 -inch water main on the west side of Olive Road. There is
sufficient flow at this time for the area.
South Bend's sewage collection system and water distribution system have adequate capacity to
service this developing industrial area. No new expenditures will be needed to existing facilities.
Revenue to the Water Works and the Division of Environmental Services will be sufficient to
provide operation and maintenance of the water distribution facilities and the sewage collection
facilities.
Streets - A new street, starting at the western edge of Olive Road will be constructed. The Street
Department will accomplish street sweeping, snow removal and normal maintenance, once the
surface course of pavement is complete and accepted by the Board of Public Works. The
additional roadway mileage will increase the Motor Vehicle Highway fund sufficiently to
maintain and operate the roadways. The cost of the new street to service this area will be a shared
cost between the water works and sewage funds. The remainder of the City's portion will be paid
out of the Airport TIF District fund, Water Works funds (bond) and an Indiana Department of
Commerce Grant.

The City will bear the expense of electricity for a street lighting system as soon as lights are
installed. This could amount to as much as $300.00 / month, from the General Fund.
When fully developed, this annexation area is not expected to require major capital outlays for
public works vehicles or equipment.
There are no waivers on file for water or sewer.
Extensions of, or taps into sanitary sewer and water lines shall be governed by I.C. 36- 9 -22 -2,
I.C. 8 -1.5 -3 and 4, and the rules and regulations of the South Bend Water Works and Sewer
Utility.
B. Police Department
The Annexation Area will be added to Beat 22.
Police patrols, traffic enforcement and emergency responses will be part of the services the City
will offer to the area. Police services and response time in this area can be expected to be
comparable and consistent with that as in other parts of the City.
The Police Department will respond to calls for service upon the reprogramming of the 911
Emergency Response System. This may occur approximately one month from the effective date
of the Annexation. Full and dedicated police response will be in place within one year of the
effective date of the Annexation.

The Annexation Area will be serviced primarily by Station #11, located at 3505 North Bendix
Drive approximately four and one -half (4.5) miles away. Additional Fire Department units would
respond from Fire Station #7 located at 1616 Portage Avenue which is approximately six and one-
half (6.5) miles away, and Station #4 which is approximately five and one -half (5.5) miles away at
220 N. Olive Street.
The South Bend Fire Department does not foresee any unusual fire protection problems related to
this annexation. Response times will be comparable to other areas of the City. No additional
equipment will need to be purchased or personnel hired to service the Annexation Area at this
time. This annexation is part of a growing industrial area. A new Station 12 is being planned for
this area of the City, but is not needed to be in place to appropriately service the Annexation Area.

The Department of Code Enforcement will be able to provide services to the Annexation Area
with comparable response times. The Department will respond to calls for service upon the

The Annexation Area will not be serviced by the Bureau of Solid Waste, since the development
will be industrial in nature.
F. Administrative Services
The City of South Bend provides a wide range of services other than those noted above, such as
the Mayor's office, Legal Department, Youth Services Bureau, etc.
These services are available upon the effective date of the Annexation. Full and dedicated
response will be in place within one year of the effective date of the Annexation.
The incorporation of the Annexation Area will not effect the provision of other services currently
provided to this property on a county -wide basis. The St. Joseph County Health Department, the
St. Joseph County Public Library, the Area Plan Commission and the St. Joseph County /South

Bend Building Department are some of the county -wide agencies that will continue to provide the
same type and level of services to the Annexation Area.
County -wide services will continue to be supported by the County and Township tax rates that
will remain in effect.
SECTION IV. FISCAL IMPACT
1) Essential city services and facilities are or can be made available to the residents of the Annexation Area.
2) The city is financially able to support city services to the territory sought to be annexed.
3) Certain improvements will be made by the petitioner and/or owner. Improvements must be made according the
standards of the City of South Bend.
All figures are estimates. Final cost of capital expenditures, if any, will not be determined until
bids are publicly solicited, contracts are awarded and projects are closed out. Property tax revenue
estimates are based on 1999 payable 2000 tax rates, taxes paid in previous years by a comparable
development, estimates of units built, and no tax abatements or adjustments. Tax rates are subject
to change every year. Other revenue estimates are based on revenue received in 1999.
