cabs within the city limits of the City of South Bend, an addi- <br />tional bond or bonds in the penal sum of Five Hundred Dollars <br />($500.00) shall be deposited by said owner or operator and secured <br />as above set forth for each cab operated by him or it over and <br />above twenty -five (25) in number. Said bond shall be conditioned, <br />among other things, that the owner or operator of said taxicab or <br />taxicabs will pay any final judgment that may be rendered against <br />him or it for damages to the property of others or for the bodily <br />Injuries to or death of others resulting from accident or eollisio . <br />for which said owner or operator will be liable on account of aly <br />acts of negligence of his or his agents or servants in the negli- <br />gent operation of or defective construction of said taxicab or <br />taxicabs, or which may arise or result from any violation of any <br />of the provisions of this ordinance or of the laws of the State of <br />Indiana by his or its agents or servants. In the event said opera- <br />tor, who has thus deposited with the City Controller a bond or <br />bonds as in this section provided, should not pay any final judg- <br />ment that may be rendered against him or it for damages, as above <br />provided, within sixty (60) days after the entry of such final <br />judgment, or in case of appeal within sixty (60) days after the <br />affirmation of said judgment, the cash or bonds so deposited with <br />the City Controller may be used by that official for the purpose <br />of liquidating any and all such claims. The sum of Twenty Thousand <br />020,000.00) Dollars, plus Five Hundred Dollars ($500.00)0 for <br />each additional cab over twenty -five (25), in cash or that amount <br />of face value government bonds so deposited as security with the <br />City Controller by said licensee shall at all times remain intact <br />in that full amount so that if all or any part of this cash fund <br />or government bonds given as security shall be used by the City <br />Controller in the liquidation of unpaid judgments against said <br />censee,the said licensee shall forthwith d6posit and make good <br />the deficit so as to bring the principal amount of this guaranty <br />5. <br />
