ORDINANCE NO. <br />AN ORDINANCE TO AMEND SECTIONS 1, 9, 11 and 12�' <br />OF ORDINANCE NO. 33770 ADOPTED JULY 140 1941, <br />COMMONLY KNOWN AS RUBBISH HAULING ORDINANCE, <br />AND ADDING A NEW SECTION THERETO TO BE KNOWN <br />AS SECTION NO. 11.1 %2* <br />BE IT ORDAINED by the Common Council of the City, of South Bend# <br />Indiana: <br />Section 1* That Section l of Ordinance No* 3377 be and the same is <br />hereby amended to read as follows: Section le No person, firm, partnership# <br />or corporation shall deposit, cause to be deposited, or allow to be deposited, <br />on land which he, she or it, owns or leases, or on any other land, public or <br />private, obnoxious, unwholesome, unsanitary, or odoriferous material, or <br />materials, tin cans, glass, ashes or any other matter, object or thing <br />which is either unsightly, unpleasant, unaesthetic or unsafe, at any place <br />within the city limits of South Bend, Indiana, or at any place which is <br />less than one"quarter mile from the corporate limits thereof, except as <br />in this ordinance otherwise provided. <br />Section 2. That Section 9 of said Ordinance No* 3377 be and the <br />same is hereby amended to read as follows: Section 9* No person, firm, <br />partnerships, or corporation shall transport, carry or haul any of the <br />materials, things or objects mentioned in Section l without first having <br />obtained a license from the City Controllers <br />Section 3* That Section 11 of the aforesaid Ordinance No* 3377 be <br />and the same is hereby amended to read as follows: Section 11* The City <br />Controller shall charge the sum of Six ($6*00) Dollars annually for each <br />license granted for the transportation of materials mentioned in Section <br />1, which license shall terminate on the 31st day of December of each years <br />For each vehicle licensed the 'City Controller shall furnish a number plate <br />which the owner or lessee of said vehicle mist display on said vehicle in <br />a prominent place so as to be visible at all times* <br />Section 4* That Section 12 of aforementioned Ordinance Nos 3377 <br />be and the same is hereby amended to read as follows: Section 12. The <br />materials, objects or things named in Section 1 hereof shall not, while <br />being transported, be above the level of the side boards and tail gate <br />of the vehicle unless such materials, objects or things are within closed <br />containers* The vehicle transporting such objects shall at all times, <br />except when being loaded or unloaded, be kept completely and securely <br />covered so that no part of the contents thereof shall at any time be <br />able to scatter or be exposed to view* <br />Section 59 That a new Section to be known as Section 11.+12 is <br />added to said Ordinance Aio* 3377 and the same is to read as follows: <br />Section 11.12* All existing licenses shall be and are hereby terminated <br />within sixty (60) days from and after the passage of this ordinance by <br />the Common Council and its legal publication and approval by the Mayor* <br />Section 6e This ordinance shall be in effect from and after its <br />passage by the Common Council, its approval by the Mayor and its legal <br />publication. <br />Iet A 2nd REAO31O //— /'d <br />CGMOTTEE OF THE B <br />PUBLIC HEARING y,aG ��a er o the ommoa Counc <br />3rd READING el— <br />NOT <br />NOT A <br />R@fE�- c�w��c�.i�f� <br />PASBED ,►1 G• • ¢� <br />
