Ordinance Amending Vacant Building Maintenance and Registration Regulations <br />Page 2 <br />(3) If the building is used or zoned for residential purposes and contains more than three (3) <br />residential units, or if it is used or zoned for any non - residential purposes, the fee shall be <br />two hundred and fia.. dell^..^ ($250.00) five hundred dollars ($500.00) for the first year or <br />any part thereof, three hundred d seventy five dell ($375.00 seven hundred fifty <br />dollars ($750.00) for the second year or any part thereof, and five hundred dollars <br />($500.000) one thousand dollars ($1,000.00) for the third and each subsequent year or any <br />part thereof that the property is required to be registered pursuant to this section. <br />(4) The purpose of the registration fee is to reimburse the Department of Code Enforcement <br />for the costs of continual monitoring the property by trained staff, and the additional costs <br />of responding to emergencies and property maintenance requirements for a vacant and <br />abandoned building, which includes but is not limited to personnel costs associated <br />therewith to see that there is compliance with regard to repairs, demolition, blight <br />elimination, deconstruction, and legal expenses incurred by the city. <br />(5) The Director of Code Enforcement shall have the limited authority to waive accrued fees <br />and /or fines on a case by case basis when those costs are determined to impede positive <br />action on an individual property to rehabilitate it for public benefit. <br />Section II. If any part, subsection, section, paragraph, sub - paragraph, sentence, clause, <br />phrase or word of this ordinance is for any reason declared to be unconstitutional or otherwise <br />invalid by a Court of competent jurisdiction, such decision shall not affect the validity of the <br />remaining portions of this ordinance. <br />Section IIl. this ordinance shall be in full force and effect from and after its passage by the <br />Common Council, approval by the Mayor, and legal publication. <br />Tim Scott, I" District Council Member <br />South Bend Common Council <br />12�ioa- <br />John Voorde, City Clerk <br />
