To encourage the redevelopment and rehabilitation of vacant and <br />abandoned homes, the Board hereby establishes the following reimbursements for construction <br />of sidewalk and/or curb for any property that is on the most recent Vacant and Abandoned <br />Homes List as determined by the Department of Code Enforcement. <br />5° Wide Sidewalk Only $40 /Lineal Foot <br />1.6" Curb Only $30 /Lineal Foot <br />Section 4 Costs incurred for the necessary construction of accessible sidewalk ramps <br />in compliance with the Americans with Disabilities Act will be subject to approval by the City <br />Engineer or designee and reimbursed at a cost of $950.00 each. <br />Section 5. The Board further and hereby establishes another sidewalk and curb <br />replacement program at no charge to the homeowner (the Fully Subsidized Sidewalk and Curb <br />Replacement Program a/k/a "The Fully Subsidized Program "), which Program requires that the <br />curb and/or sidewalk be in poor or very poor condition and that homeowners be selected using <br />objective criteria. <br />Section 6. The selection of those sidewalks and/or curbs in very poor condition <br />eligible for replacement under the Fully Subsidized Program shall be initiated by each member <br />of the South Bend Common Council. Each Council member shall have the ability to select <br />program participants based on objective criteria developed by the South Bend Common Council <br />for up to an aggregate of 700 feet of sidewalk and 900 feet of curb for each Council member <br />during calendar yen 2015, or alternatively, 1,150 feet of sidewalk only or 1,400 feet of curb <br />only. <br />Section 7. The Council member shall submit to the South Bend Department of Public <br />Works the list of properties for participation in the Fully Subsidized Program on a "Council <br />Allocation Form ", a copy of which is attached as Exhibit A hereto, and for each property, the <br />Council member shall include the entire lot width, from property line to property line. <br />Section 8. Final selection of sidewalks and/or curbs eligible for replacement under the <br />Fully Subsidized Program shall be made by the City's Department of Public Works and the <br />Common Council, with the Department of Public Works performing a condition analysis of each <br />proposed Project property and, if necessary, a ranking of the properties in terms of condition, and <br />notifying each Council members of the properties approved based on condition. <br />Section 9.
